Dossiers for compulsory rehabilitation in rehabilitation centers for Vietnamese residents aged 12 to under 18
Pursuant to Clause 1, Article 50 of Decree 116/2021/ND-CP, regulations regarding the components of the dossier for compulsory rehabilitation in rehabilitation centers for Vietnamese residents aged 12 to under 18 are as follows:
- For drug addicts aged 12 to under 18 with permanent residence:
a) 01 violation report on one of the violations of the law regarding registration for rehab, voluntary rehab at home, in the community, or opioid addiction treatment with substitutes according to Form no. 27 in Appendix II of this Decree;
b) 01 summary biography of the individual proposed for compulsory rehab admission according to Form no. 30 in Appendix II of this Decree;
c) 01 copy of the drug addiction status determination result from the competent authority;
d) 01 account from the drug addict aged 12 to under 18 or an account from their legal representative according to Form no. 31 in Appendix II of this Decree;
dd) 01 written opinion from the father, mother, guardian, or legal representative according to Form no. 38 in Appendix II of this Decree;
e) The Chairman of the commune-level People's Committee or the Police Agency prepares the dossier requesting the application of compulsory rehab measures in writing according to Form no. 29 in Appendix II of this Decree, accompanied by the documents stipulated in points a, b, c, and d, Clause 1, Article 50, and other related documents (if any).
Dossiers for compulsory rehabilitation in rehabilitation centers for Vietnamese non-residents aged 12 to under 18
Pursuant to Clauses 2 and 3, Article 50 of the above Decree, the regulations regarding the components of the dossier for compulsory rehabilitation in rehabilitation centers for Vietnamese non-residents aged 12 to under 18 are as follows:
- For drug addicts aged 12 to under 18 without permanent residence:
a) The documents stipulated in Clause 1 of this Article;
b) A document from the competent police authority confirming the individual’s lack of permanent residence.
- For drug addicts aged 12 to under 18 discovered, investigated, or handled directly by district-level or provincial-level police agencies in law violation cases:
a) The documents stipulated in Clause 1 of this Article;
b) Other related documents (if any).
