How many days off do employees get during the Lunar New Year in Vietnam?
According to Article 112 of the 2019 Labor Code regarding holiday:
Article 112. Holidays
- Employees are entitled to leave with full pay during the following holidays and Tet:
a) New Year: 01 day (January 1);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30);
d) International Labor Day: 01 day (May 1);
dd) National Day: 02 days (September 2 and 01 adjacent day);
e) Hung Kings' Commemoration: 01 day (10th day of the third lunar month).
- Foreign workers working in Vietnam, in addition to the holidays specified in Clause 1 of this Article, are entitled to an additional 01 traditional New Year's Day and 01 national day of their country.
- Annually, based on actual conditions, the Prime Minister of Vietnam decides specifically the holiday under item b and item dd of Clause 1 of this Article.
According to the above regulations, employees are entitled to 05 days off with full pay during the Lunar New Year. However, annually, based on actual conditions, the Prime Minister of Vietnam specifically decides the Lunar New Year holiday.
What are the penalties for enterprises violating the regulations on Lunar New Year holidays in Vietnam?
According to Article 18 of Decree 12/2022/ND-CP regarding violations of labor time, rest time:
Article 18. Violations of regulations on working hours, rest hours
- A fine from 2,000,000 VND to 5,000,000 VND for employers with any of the following actions:
a) Failing to ensure leave for employees as prescribed or unpaid leave as per legal regulations;
b) Failing to notify in writing the Department of Labor - Invalids and Social Affairs where overtime is organized and where the head office is located about organizing overtime from over 200 hours to 300 hours in a year.
2. A fine from 10,000,000 VND to 20,000,000 VND for employers who violate legal regulations on weekly, annual, or Tet holidays.
- A fine from 20,000,000 VND to 25,000,000 VND for employers with any of the following actions:
a) Having normal working hours exceed the legally stipulated working hours;
b) Mobilizing employees to work overtime without employees' consent, except in cases specified in Article 108 of the Labor Code.
- A fine for employers when having any actions like: failing to ensure employees' breaks during working hours or shift changes as per legal regulations; mobilizing employees to work overtime exceeding the stipulated hours according to the following levels:
a) From 5,000,000 VND to 10,000,000 VND for violations concerning 01 to 10 employees;
b) From 10,000,000 VND to 20,000,000 VND for violations concerning 11 to 50 employees;
c) From 20,000,000 VND to 40,000,000 VND for violations concerning 51 to 100 employees;
d) From 40,000,000 VND to 60,000,000 VND for violations concerning 101 to 300 employees;
dd) From 60,000,000 VND to 75,000,000 VND for violations concerning over 301 employees.
Thus, according to the above regulations, if enterprises compel employees to work during Lunar New Year, they will be fined from 10,000,000 VND to 20,000,000 VND depending on the severity of the case.
Note: The fines for these violations are applicable to individuals. The fines for organizations are double the fines for individuals (according to Clause 1 Article 6 of Decree 12/2022/ND-CP).
