Can a pregnant female employee in Vietnam unilaterally terminate an employment contract?

Based on Clause 2, Article 35 of the Labor Code 2019 regulating the rights for unilateral termination of an employment contract by employees in Vietnam:

Article 35. Rights for unilateral termination of an employment contract by employees

[...]

  1. The employee is entitled to unilaterally terminate the labor contract without prior notice in the following cases:

a) Not assigned the job, workplace, or not guaranteed working conditions as agreed, except in the case specified in Article 29 of this Code;

b) Not paid in full or on time, except as specified in Clause 4, Article 97 of this Code;

c) Being mistreated, beaten or having insulting words, behaviors affecting health, dignity, and honor by the employer; being forced to work;

d) Being sexually harassed at the workplace;

dd) A pregnant female employee must take leave as prescribed in Clause 1, Article 138 of this Code;

e) Eligible for retirement as prescribed in Article 169 of this Code, unless otherwise agreed by both parties;

g) The employer provides dishonest information as specified in Clause 1, Article 16 of this Code affecting the performance of the employment contract.

According to the above regulations, a pregnant female employee has the right to unilaterally terminate the employment contract without prior notice if there is a confirmation from a competent medical facility that continuing to work will negatively affect the fetus.

Is an employer allowed to unilaterally terminate the employment contract for a pregnant female employee in Vietnam?

Based on Article 37 of the Labor Code 2019 regulating cases where the employer is not allowed to exercise the right to unilaterally terminate the employment contract in Vietnam:

Article 37. Cases where the employer is not allowed to exercise the right to unilaterally terminate the employment contract

1. The employee is sick or has an accident or occupational disease and is under treatment or convalescence as directed by a competent medical facility, except in the case specified at point b, Clause 1, Article 36 of this Code.

2. The employee is on annual leave, private leave, and other leave consented to by the employer.

3. A pregnant female employee; an employee on maternity leave or raising a child under 12 months old.

According to the above regulations, the employer cannot unilaterally terminate the employment contract with a pregnant female employee.
