What are the penalties imposed for pledging the family register, temporary residence register, residence documentation or receiving them as pledge in Vietnam?

Pursuant to Clause 2, Article 9 of Decree 144/2021/ND-CP, a fine ranging from VND 1,000,000 to VND 2,000,000 shall be imposed for any of the following acts:

a) Erasing, altering, or engaging in other acts that distort the contents of the household registration book, temporary residence book, residence information confirmation, and other papers related to residence;

b) Buying, selling, renting, leasing the household registration book, temporary residence book, residence information confirmation, and other papers related to residence to commit acts contrary to the law;

c) Borrowing, lending, or using the household registration book, temporary residence book, residence information confirmation, and other papers related to residence to commit acts contrary to the law;

d) Residing at the new legal residence with sufficient conditions for residence registration but not completing the procedure to change the residence registration place in accordance with the law;

dd) Operating accommodation business, collective housing, medical treatment establishments, tourist accommodation, and other establishments with accommodation functions without notifying about accommodation for 01 to 03 persons;

e) Organizing, inciting, instigating, inducing, brokering, and coercing others to violate the law on residence;

g) Pledging the family register, temporary residence register, residence documentation or receiving them as pledge;

h) Destroying household registration books, temporary residence books, documents, and papers related to residence.

Accordingly, under current regulations, pledging or receiving pledged household registration books, temporary residence books, documents, and papers related to residence shall be fined from VND 1 million to VND 2 million for individuals, and from VND 2 million to VND 4 million for organizations (pursuant to Clause 2, Article 4 of Decree 144).

How much is the fine for giving, brokering, receiving bribes in residence registration and management in Vietnam?

Moreover, Clause 3 of this Article stipulates a fine ranging from VND 2,000,000 to VND 4,000,000 for any of the following acts:

a) Allowing others to register residence in one's place for personal gain;

b) Operating accommodation business, collective housing, medical treatment establishments, tourist accommodation, and other establishments with accommodation functions without notifying about accommodation for 04 to 08 persons;

c) Obstructing citizens from exercising their right to free residence;

d) Giving, brokering, receiving bribes in residence registration and management.

Thus, according to current regulations, the act of giving, brokering, receiving bribes in residence registration and management shall be fined from VND 2 million to VND 4 million for individuals, and from VND 4 million to VND 6 million for organizations (pursuant to Clause 2, Article 4 of Decree 144).
