In October 2024, is there any day where employees in Vietnam are entitled to full paid leave?
Pursuant to Article 112 of the Labor Code 2019 which stipulates public holidays in Vietnam:
Article 112. public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays and Tet:
a) New Year’s Day: 01 day (January 1 of the Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 of the Gregorian calendar);
d) International Labor Day: 01 day (May 1 of the Gregorian calendar);
dd) National Day: 02 days (September 2 of the Gregorian calendar and 01 adjacent day before or after);
e) Hung Kings' Ancestral Death Anniversary: 01 day (March 10 of the lunar calendar).
2. Foreign employees working in Vietnam are entitled to an additional 01 day off on their traditional New Year and 01 day on their National Day, aside from the holidays prescribed in Clause 1 of this Article.
3. Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides the specific days off prescribed in Points b and đ of Clause 1 of this Article.
According to the above regulations in Vietnam, employees are entitled to paid leave on the following days:

- Hung Kings' Ancestral Death Anniversary
Furthermore, foreign employees working in Vietnam are entitled to an additional day off on their traditional New Year and on their National Day.

How many days of annual leave are employees with working period under 12 months in Vietnam are entitled to?
Pursuant to Article 113 of the Labor Code 2019 which stipulates annual leave as follows:
Article 113. Annual Leave
- Employees who have worked for an employer for a full 12 months are entitled to annual leave with full pay in accordance with the labor contract as follows:
a) 12 working days for employees working under normal conditions;
b) 14 working days for minors, employees with disabilities, persons engaged in heavy, hazardous, or dangerous occupations or jobs;
c) 16 working days for persons engaged in particularly heavy, hazardous, or dangerous occupations or jobs.
- Employees who have not worked for a full 12 months for an employer shall be entitled to annual leave in proportion to the number of months worked.
- Employees who leave or lose their job without having taken their annual leave or without having taken all their annual leave shall be paid wages in lieu of the days not taken.
- Employers are responsible for fixing the annual leave schedule after consulting with employees and must notify employees in advance. Employees can agree with employers to take annual leave in several periods or to accumulate leave over up to 03 years.
- During annual leave when the payment date has not yet come, employees shall be entitled to salary advances according to Clause 3, Article 101 of this Code.
