Can foreigners in Vietnam receive full salary during the Lunar New Year in 2025 in Vietnam?

Based on Article 112 of the Labor Code 2019 regulating holiday:

Article 112. Holiday

  1. Employees are entitled to holiday leave with full salary on the following holidays:

a) New Year's Day: 1 day (January 1, Gregorian calendar);

b) Lunar New Year: 5 days;

c) Victory Day: 1 day (April 30, Gregorian calendar);

d) International Labor Day: 1 day (May 1, Gregorian calendar);

dd) National Day: 2 days (September 2, Gregorian calendar and 1 contiguous day before or after);

e) Hung Kings Commemoration Day: 1 day (March 10, lunar calendar).

  1. Foreign employees in Vietnam, in addition to the holidays stipulated in Clause 1 of this Article, are also entitled to one traditional Lunar New Year holiday and one National Day of their own country.
  1. Annually, based on practical conditions, the Prime Minister of the Government of Vietnam specifically decides the holiday dates stipulated in Points b and dd, Clause 1 of this Article.

According to the above regulations, foreigners working in Vietnam are entitled to leave with full salary during the Lunar New Year 2025. In addition, foreigners working in Vietnam are entitled to leave with full salary on the following days:

- New Year's Day: 1 day (January 1, Gregorian calendar)

- Victory Day: 1 day (April 30, Gregorian calendar)

- International Labor Day: 1 day (May 1, Gregorian calendar)

- National Day: 2 days (September 2, Gregorian calendar and 1 contiguous day before or after)

- Hung Kings Commemoration Day: 1 day (March 10, lunar calendar).

How many annual leave days do employees in regular working conditions in Vietnam have?

Based on Article 113 of the Labor Code 2019 regulating annual leave:

Article 113. Annual Leave

  1. Employees who have worked for an employer for 12 months are entitled to annual leave with full salary according to their labor contract as follows:

a) 12 working days for those in regular working conditions;

b) 14 working days for juvenile employees, employees with disabilities, or those in arduous, toxic, or hazardous jobs;

c) 16 working days for those in particularly arduous, toxic, or hazardous jobs.

  1. Employees who have not worked for 12 months for an employer are entitled to annual leave proportionate to the number of months worked.
  1. In cases of termination or job loss where annual leave has not been taken, the employer shall pay the employee for the unused leave days.
  1. Employers are responsible for setting the annual leave schedule after consulting with employees and must notify employees in advance. Employees can negotiate with the employer for annual leave to be divided into several times or be accumulated for up to 3 years.

According to the above regulations, employees in regular working conditions who have worked for an employer for 12 months are entitled to 12 days of annual leave.

Additionally, for every 5 years of service with the same employer, the employee's annual leave is increased by one additional day. (Regulation in Article 114 of the Labor Code 2019)
