Press Article Accusing of Criminal Charges Without a Conviction Sentencing Fined 50 Million?
According to Point b, Clause 4 and Points a, b, Clause 10, Article 8 of Decree 119/2020/ND-CP (Effective from December 1, 2020) stipulates the following:
- A fine ranging from VND 30,000,000 to VND 50,000,000 for the following act: Attributing a crime when there is no effective court conviction.
- Measures to remedy consequences:
+ Compelling the press agency to make corrections and apologize for the behavior specified in points a, b, and c, clause 2; points a, b, c, d, i, and k, clause 3; points a, b, c, and d, clause 4; points a, b, and c, clause 5; clauses 6, 7, and 8 of this Article.
+ Compelling the removal of false information, information violating legal regulations that have been posted on electronic newspapers, electronic magazines, radio, television, for the acts of violation specified in points a, b, and c, clause 2; points a, b, c, d, i, and k, clause 3; points a, b, c, and d, clause 4; points a, b, and c, clause 5; clauses 6, 7, and 8 of this Article.
Thus, if a press agency commits the act of posting an article attributing a crime when there is no effective court conviction, it may be fined up to VND 50 million.
