Is it possible to receive an advance on salary during Christmas 2024 in Vietnam?

Based on Article 101 of the Labor Code 2019 concerning salary advances:

Article 101. Salary Advance

  1. Employees can advance their salary under conditions agreed upon by both parties and without interest.
  1. Employers must allow employees to advance a salary corresponding to the number of days the employee temporarily takes leave to fulfill civic obligations for 01 week or more, but not exceeding 01 month of salary according to the labor contract, and employees must repay the advanced amount.

Employees enlisted as per the Military Service Law are not eligible to advance their salaries.

  1. Annually, employees are entitled to advance an amount at least equal to the salary of the days of leave.

Hence, Christmas is not a paid holiday. If employees wish to advance their salary for Christmas 2024, they can negotiate with their employers.

Are employees in Vietnam entitled to a day off on Christmas 2024?

Based on Article 112 of the Labor Code 2019 regarding holiday leave:

Article 112. Holidays, Public Holidays

  1. Employees are entitled to leave work and receive full pay on the following holidays:

a) New Year's Day: 01 day (January 01 of the Gregorian calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30 of the Gregorian calendar);

d) International Labor Day: 01 day (May 01 of the Gregorian calendar);

dd) National Day: 02 days (September 02 of the Gregorian calendar and one day immediately before or after);

e) Hung Kings' Commemoration Day: 01 day (March 10 of the lunar calendar).

  1. Foreign workers in Vietnam, in addition to the holidays prescribed in Clause 1 of this Article, are entitled to one traditional national holiday and one National Day of their country.
  1. Annually, based on actual conditions, the The Prime Minister of the Government of Vietnam specifically decides the leave days stipulated at Points b and dd of Clause 1 of this Article.

According to the above regulations, employees are entitled to leave work and receive full pay on the following days:

- New Year's Day: 01 day (January 01 of the Gregorian calendar)

- Lunar New Year: 05 days

- Victory Day: 01 day (April 30 of the Gregorian calendar)

- International Labor Day: 01 day (May 01 of the Gregorian calendar)

- National Day: 02 days (September 02 of the Gregorian calendar and one day immediately before or after)

- Hung Kings' Commemoration Day: 01 day (March 10 of the lunar calendar)

Furthermore, foreign workers in Vietnam are also entitled to one additional traditional national holiday and one National Day of their country.

Christmas 2024 is not a public holiday for which employees are entitled to leave with full pay. Therefore, employees do not get a day off on Christmas 2024.

However, employees can take a day off on Christmas 2024 in the following cases:

- The company's internal regulations specify a weekly day off on Friday according to Article 111 of the Labor Code 2019.

- Annual leave on Christmas 2024 as prescribed in Article 113 of the Labor Code 2019.

- Personal leave on Christmas 2024 with or without pay as prescribed in Article 115 of the Labor Code 2019.
