How is the Penalty for Wearing Police Uniforms for Virtual Living?
Based on Article 19 of Decree 167/2013/ND-CP on handling violators of the law regarding the management and use of uniforms, insignia, badges, and identification numbers specific to the People's Police force as follows:
- A fine ranging from 500,000 VND to 1,500,000 VND for illegally storing or using uniforms, insignia, badges, and identification numbers.
- A fine ranging from 5,000,000 VND to 10,000,000 VND for illegally buying, selling, or exchanging uniforms, insignia, badges, and identification numbers.
- A fine ranging from 10,000,000 VND to 30,000,000 VND for illegally producing or counterfeiting uniforms, insignia, badges, and identification numbers.
- Additional sanctions:
Confiscation of the offending items and means of administrative violations for the acts specified in Clauses 1, 2, and 3 of this Article.
Foreigners who commit administrative violations specified in Clauses 1, 2, and 3 of this Article may, depending on the level of the violation, be subject to expulsion from the Socialist Republic of Vietnam.
Additionally, Article 339 of the Criminal Code 2015 stipulates the crime of impersonating a position, rank, or working position as follows:
Anyone who impersonates a position, rank, or working position to carry out illegal acts but not for the purpose of asset appropriation shall be subject to non-custodial reform for up to 02 years or imprisonment from 03 months to 02 years.
Thus, according to current regulations, the act of wearing police uniforms for virtual living is considered unauthorized use of uniforms, insignia, badges, and identification numbers and will be fined from 500,000 VND to 1,500,000 VND (Clause 2, Article 4 of Decree 167). In cases of impersonation, the individual will be subject to criminal prosecution with the maximum penalty of up to 02 years in prison.
