Handling of a Communist Party Member Who Assaults Others
* Disciplinary Action by the Communist Party
Article 33 of Regulation 102-QD/TW in 2017 outlines the disciplinary actions for Communist Party members violating the rule on "causing disturbances, quarrels, fighting, or displaying uncultured behavior that disrupts public order and security" as follows:
- If this behavior causes minor consequences, the Communist Party member will be disciplined with a reprimand.
- If the Communist Party member has already been disciplined for fighting and repeats the offense or commits a first-time offense that causes serious consequences, they will be disciplined with a warning or removal from position (if they hold a position);
- In cases where the Communist Party member causes very serious consequences by fighting, they may be expelled from the Communist Party.
* Administrative Penalty
The act of fighting by a Communist Party member may be subject to administrative penalties according to Clause 2a, Article 5 of Decree 167/2013/ND-CP, specifically:
A fine ranging from VND 500,000 to VND 1,000,000 for one of the following acts: Fighting or inciting others to fight.
* Criminal Liability
Additionally, if a Communist Party member is involved in assaulting someone, they could also face criminal liability for the crime of intentionally causing injury or harm to another person's health according to Clause 22, Article 1 of the Law amending the Criminal Code 2017 (amending Article 134 of the Criminal Code 2015).
Anyone who intentionally causes injury or harm to another person's health with a body injury rate from 11% to 30% or below 11% but falls into one of the following cases will be sentenced to non-custodial rehabilitation for up to 3 years or imprisonment from 6 months to 3 years:
- Using weapons, explosives, dangerous tools, or methods that have the potential to endanger many people;
- Using dangerous acids or dangerous chemicals;
- Against persons under 16 years of age, pregnant women known to the perpetrator, elderly, sick persons, or others incapable of self-defense;

Thus, in cases where a Communist Party member assaults someone, they will be dealt with as described above.
