First-time Offenders: Eligibility for Probation Period Reduction?
Your friend who is granted early release from prison may have their probation period shortened if they meet the conditions prescribed in Article 6 of Resolution No. 01/2018/NQ-HDTP, which include:
- Having served at least half of the probation period;
- Showing significant progress demonstrated by adhering strictly to the law and obligations during the probation period; actively engaging in learning, labor, rectifying mistakes, achieving commendable accomplishments in production labor, national security protection, etc., and receiving commendation from a provincial-level authority or higher.
Thus, if your friend has served at least half of the probation period and has shown significant progress recognized by a provincial-level authority or higher, the probation period may be shortened. Committing a first-time offense is not a basis for shortening the probation period.
