What are details of Decree 119/2024/ND-CP on electronic payment in road transport in Vietnam?
On September 30, 2024, the Government of Vietnam issued Decree 119/2024/ND-CP Download, regulating electronic payment in road transport, which takes effect from October 1, 2024.
Article 4 of Decree 119/2024/ND-CP Download stipulates the general principles for electronic payment in road transport as follows:
[1] Ensure transparency in electronic payment of fees, prices, and service charges related to vehicle operations.
[2] Ensure the interconnectivity requirements between the components of the electronic payment system for transportation. Each vehicle is to be equipped with one terminal card at any given time.
[3] Ensure the safety and confidentiality of personal information of vehicle owners in accordance with legal regulations on personal data protection, except when providing information as decided by competent state authorities in accordance with the law.
[4] Ensure complete and prompt information integration and provision to serve the objectives of state management according to legal regulations.
[5] Ensure the right of vehicle owners to choose and use value-added services and utilities.

Prohibited acts in the activity of electronic payment in road transport
According to Article 5 of Decree 119/2024/ND-CP Download stipulating prohibited acts in the activity of electronic payment in road transport in Vietnam:
Article 5. Prohibited acts in the activity of electronic payment in road transport
Destroying, falsifying, deleting data or altering the content of terminal cards; transferring terminal cards from one participating vehicle to another.
Hacking or attempting to hack, damage, steal data, or unauthorizedly alter software programs and electronic data used in electronic payment in road transport; exploiting computer network system errors for profit.
Providing untruthful information during the process of participating in electronic payment activities for road transportation.

Thus, the prohibited acts in the activity of electronic payment in road transport include:
- Destroying, falsifying, deleting data, or altering the content of terminal cards; transferring terminal cards from one participating vehicle to another.
- Hacking or attempting to hack, damage, steal data, or unauthorizedly alter software programs and electronic data used in electronic payment in road transport; exploiting computer network system errors for profit.
- Providing untruthful information during the process of participating in electronic payment activities for road transportation.
- Disclosing or providing information related to personal data not in accordance with the law.
- Opening or maintaining anonymous or counterfeit traffic accounts.
- Intentional evasion or fraud in electronic payment in road transport.
- Unfair competition between electronic payment service providers for transportation.
Road traffic principles in Vietnam
According to Article 4 of the Law on Road Traffic 2008, the road traffic principles in Vietnam include:
- Road traffic must be uninterrupted, orderly, sale and effective, contributes to socio-economic development, defense and security assurance and environmental protection.
- Road traffic shall be developed according to planning towards modernization and synchronism; transportation by road shall be combined with other modes of transportation.
- Road traffic administration shall be implemented uniformly on the basis of assignment and decentralization of specific responsibilities and powers and close coordination among ministries, branches and local administrations at all levels.
- Ensuring road traffic order and safety is the responsibility of agencies, organizations and individuals.
- Road users shall self-consciously and strictly observe traffic rules and ensure safety for themselves and others. Vehicle owners and operators shall take responsibility before law for ensuring that their vehicles operate safely in road traffic.
- All acts of violating the road traffic law shall be detected and prevented in time and handled in a strict and lawful manner.
