What Is the Fine for Selling Fuels Valued Under 10 Million VND Across the Border?
According to Point a, Clause 1, Article 31 of Decree 99/2020/ND-CP (effective from October 11, 2020), it is stipulated as follows:
"1. For acts of transporting, buying, selling, or exchanging petroleum across borders or from non-tariff zones into the domestic market or vice versa in violation of the law, the fine levels are as follows:
a) A fine ranging from VND 5,000,000 to VND 10,000,000 in cases where the value of the violated petroleum is under VND 10,000,000;
…”
In addition, Article 5 of this Decree stipulates: The fine levels specified in Chapters II, III, and IV of this Decree are the fine levels applicable to organizations. In cases where administrative violations are committed by individuals, the fine imposed shall be half of the fine level applicable to organizations.
This Article 31 falls under Chapter III, so the above fine levels apply to organizations. Therefore, individuals committing violations will be fined half of the fine level applicable to organizations.
Thus, any individual who buys or sells petroleum valued under VND 10,000,000 across borders in violation of the law will be fined from VND 2,500,000 to VND 5,000,000.
