How to determine the electricity price in case the buyer uses electricity for multiple purposes in Vietnam?
Pursuant to Clause 2 Article 3 of the Circular 16/2014/TT-BCT (amended by Clause 1 Article 1 of the Circular 25/2018/TT-BCT), in case the buyer uses electricity for multiple purposes, the electricity price shall be determined as follows:
- As for customers who register one electric meter for domestic purpose but use part of the amount of electricity from such meter for other purposes (production, business and services…), retail price for domestic purpose shall be applied for all the amount of electric energy measured by such meter;
- As for customers who register one electric meter for purposes other than domestic purpose (hereinafter referred to as non-domestic purposes), the two sides shall negotiate the proportion of electricity used for each using purpose in reliance on real-life usage.
- With regard to an urban area or a multistory building of which houses and apartments have been transferred to clients but the electrical grid is not yet transferred to the competent electricity agency because of failure to complete property statement procedures:
Pending the transfer of the electrical grid and electric consumption by clients, the buyer and the seller shall, based on the actual consumption of electricity, carry out an agreement on the amount of electricity to which the retail price for domestic purpose is applied and the amount of electricity to which the retail price for non-domestic purposes (such as production, business, service provision, etc.) is applied; this agreement shall be used as the basis for application of electricity prices.
The price of electricity used for domestic purpose shall be applied to total amount of electricity used by the buyer which is determined by the amount of electricity of each level multiplied by the number of households using electricity for domestic purpose (based on actual purposes of electricity consumption, apartment sales agreement, record of apartment transfer, family register, temporary residence register or document certifying registered temporary residence granted by local police agency).

At what voltage level can customers in border areas in Vietnam purchase directly from foreign countries?
Pursuant to Article 22 of the Decree 137/2013/NĐ-CP stipulating sale and purchase of electricity with foreign countries as follows:
Sale and purchase of electricity with foreign countries
1. The authority competent to permit the sale and purchase of electricity with foreign countries defined at Clause 1 Article 28 of the Electricity Law includes:
a) The Prime Minister who shall approve policies for the sale and purchase of electricity with foreign countries through national power grid at voltage of 220 kV or more. The Ministry of Industry and Trade shall consider proposals of the sale and purchase of electricity with foreign countries of electricity units, and submit them to the Prime Minister;
b) The Ministry of Industry and Trade shall approve policies of the sale and purchase of electricity with foreign countries through national power grid at voltage of less than 220 kV at the request of electricity units.
2. Customers using electricity at border areas defined at Clause 3 Article 28 of the Electricity Law may only buy electricity directly with foreign countries at voltage of 0.4 kV and must meet fully the following conditions:
a) Being Vietnamese citizens;
b) Having scale of capacity of electricity use of less than 10 kW and not connecting into the national electrical system or power grid on the spot;
c) All parts of power grid from boundaries to location of electricity user are invested and managed operation by the electricity purchaser;
d) Ensuring the standards, technical regulations on electrical safety;
dd) Getting consent of the district-level People’s Committees.
3. The provincial People’s Committees shall guide, manage, supervise, and examine the purchase of electricity with foreign countries as prescribed at Clause 2 of this Article.
As regulations above, customers using electricity at border areas may only buy electricity directly with foreign countries at voltage of 0.4 kV.
Note: customers using electricity at border areas may only buy electricity directly with foreign countries as long as they meet following conditions:
- Being Vietnamese citizens;
- Having scale of capacity of electricity use of less than 10 kW and not connecting into the national electrical system or power grid on the spot;
- All parts of power grid from boundaries to location of electricity user are invested and managed operation by the electricity purchaser;
- Ensuring the standards, technical regulations on electrical safety;
- Getting consent of the district-level People’s Committees.
