What is an Individual Engaged in Commercial Activities?
The concept of individuals engaging in commercial activities is defined in Clause 1, Article 3 of Decree 39/2007/ND-CP regarding individuals engaging in independent, regular commercial activities without having to register a business, with the content as follows:
Individuals engaging in commercial activities are individuals who independently carry out, on a day-to-day basis, one, a few, or all activities permitted by law regarding the sale of goods, provision of services, and other activities for profit-making purposes. However, they are not subject to business registration under the law's provisions on business registration and are not referred to as “traders” according to the Commercial Law.
