What are the fines for allowing customers to perform strip dancing in the clubs in Vietnam?

Pursuant to Clause 5 and 6, Article 16 of the Decree 38/2021/NĐ-CP stipulating as follows:

5. Imposing the fine ranging from 40,000,000 dong to 50,000,000 dong for the act of allowing customers to perform naked dancing or other debauched activities at club discos, karaoke bars, or tourist accommodation establishments, restaurants, other public cultural centers and public cultural service businesses.

6. Other supplementary penalties:

The penalty existing in the form of seizure of the right to use certificates of conformance to karaoke or discotheque service business regulations for the period of between 18 months and 24 months shall be imposed for the violations prescribed in clause 4 and 5 of this Article;

Pursuant to Article 5 of the Decree 38/2021/NĐ-CP stipulating as follows:

1. The maximum amount of fine upon an individual or an organization for an administrative violation arising from cultural activities shall be 50,000,000 dong and 100,000,000 dong, respectively. The maximum amount of fine upon an individual or an organization for an administrative violation arising from advertising activities shall be 100,000,000 dong and 200,000,000 dong, respectively.

2. The amounts of fine specified in Chapter II and Chapter III of this Decree are imposed on individuals while those specified in clause 1, point c clause 4, point a clause 5 and 6 of Article 6; point c, dd, e and g clause 4 of Article 8; clause 1, 2 and 3 of Article 9; Article 10; point a clause 2, clause 3, 5 and 6, point a, b, c and d clause 7 Article 14; clause 1, 2, 3, 4 and point b clause 5 Article 21; clause 1, 2, 3, 4 and point b clause 5 Article 23; clause 1 of Article 24; Article 30, 38, 39 and 40 of this Decree are applicable to organizations.

3. If an organization commits the same violation, the amount of fine imposed on that organization shall be 02 times greater than that imposed on an individual.

4. Authority to impose fines of different officeholders regulated in Chapter IV herein shall be authority to impose fines for administrative violations committed by individuals; authority to impose fines on organizations shall be 2 times as much as that on individuals.

As regulations above, if individuals allow customers to perform strip dancing, he/she shall be fined from 40,000,000 dong to 50,000,000 dong. If the violator is an organization, the fine for the violator shall be 80,000,000 dong to 100,000,000 dong.

In addition, the certificates of conformance to karaoke or discotheque service business shall be revoked for the period of between 18 months and 24 months.

What are the fines imposed on owners of the clubs in Vietnam for allowing customers to perform strip dancing in the clubs?

Pursuant to Article 27 of the Decree 144/2021/NĐ-CP stipulating abusing the business and services for prostitution activities in Vietnam as follows:

1. A fine ranging from 20.000.000 VND to 30.000.000 VND shall be imposed for prostitution or sexual activities as the business methods.

2. A fine ranging from 30.000.000 VND to 40.000.000 VND shall be imposed for a head, a legal representative, a person assigned to manage the service and business establishment(s) who allows prostitution or sexual acts to happen in the area(s) under their management

3. Additional penalties:

a) Suspend the certificate of security and order from 06 to 12 months in case of violations specified in Point a Clauses 1 and 2 of this Article;

b) Expel foreigners committing the administrative violations specified in Clauses 1 and 2 of this Article.

4. Remedial measure:

Enforced return of benefits illegally obtained from the commission of the violation in Clause 1 of this Article;

As regulations above, owners of the clubs in Vietnam shall be fined from 30.000.000 VND to 40.000.000 VND for allowing customers to perform strip dancing in the clubs under their management.

In addition, the certificate of security and order shall be suspended from 06 to 12 months.

Is strip dancing a pornographic performance in Vietnam?

Pursuant to Clause 4 Article 3 of the Resolution 06/2019/NQ-HĐTP stipulating as follows:

4. “pornographic performance” in Clause 1 Article 147 of the Criminal Code means using gestures, actions, words, writing, symbols, pictures and sound to sexually stimulate a person under 16; exposing a reproductive organ or private part, completely or partially undressing or committing other acts that imitate sexual activities (including sexual intercourse, masturbation and other sexual activities) in any shape or form.

As regulations above, strip dancing is a type of a pornographic performance in Vietnam.
