What are details of Decree 135/2024/ND-CP on mechanisms and policies to promote the development of self-produced, self-consumed rooftop solar power in Vietnam?

On October 22, 2024, the Government of Vietnam issued Decree 135/2024/ND-CP regulating the mechanisms and policies encouraging the development of self-produced, self-consumed solar power installed on the rooftops of constructions, including residential houses, office buildings, industrial parks, industrial clusters, export processing zones, high-tech zones, economic zones, production facilities, and business facilities, which are invested in accordance with the law in Vietnam.

Decree 135/2024/ND-CP takes effect in Vietnam from October 22, 2024, and applies to the following subjects:

- Organizations and individuals managing or participating in the development of rooftop solar power in Vietnam in the form of self-production and self-consumption.

- Other related organizations and individuals.

What are principles for the development of self-produced, self-consumed rooftop solar power in Vietnam?

Based on Article 4 of Decree 135/2024/ND-CP, the following principles of development are stipulated:

Article 4. Principles of Development

  1. The development of self-produced, self-consumed rooftop solar power must ensure openness, transparency, and equality among the subjects specified in this Decree.
  1. The activities of buying and selling surplus electricity (if any) from self-produced, self-consumed rooftop solar power shall be conducted in accordance with the regulations of this Decree.
  1. The capacity of self-produced, self-consumed rooftop solar power connected to the national grid in each locality must comply with the regulations of this Decree, except for self-produced, self-consumed rooftop solar power in districts and island communes with the electric grid but not yet connected to the national grid.

Thus, the development of self-produced, self-consumed rooftop solar power in Vietnam is governed by the following principles:

[1] The development must ensure openness, transparency, and equality.

[2] The activities of buying and selling surplus electricity (if any) must comply with regulations.

[3] The capacity connected to the national grid in each locality must comply with regulations, excluding areas with an existing grid that have not yet connected to the national grid.

[4] The construction must comply with current laws regarding investment, construction, land, environment, safety, and fire prevention and fighting before installing self-produced, self-consumed rooftop solar power. The development must comply with laws on electrical safety, investment, construction, environment, and fire prevention and fighting.

[5] During the investment and construction process, organizations and individuals must not use imported pre-used photovoltaic panels and devices converting direct current to alternating current.

[6] The operation of self-produced, self-consumed rooftop solar power must ensure the safety of the national power system, equally as with other renewable energy sources (solar power, wind power).

Which authority has the power to issue the certificate of registration for the development of self-produced, self-consumed rooftop solar power in Vietnam?

Based on Article 9 of Decree 135/2024/ND-CP, the authorities with the jurisdiction to issue and the conditions for issuing a certificate of registration for development are defined as follows:

Article 9. Authorities with Jurisdiction and Conditions for Issuing Development Registration Certificates

  1. Authorities with Jurisdiction for Issuing Certificates

The Department of Industry and Trade at the provincial level is responsible for receiving dossiers and issuing development registration certificates.

  1. Conditions for Issuing Development Registration Certificates

a) The registration dossier for self-produced, self-consumed rooftop solar power is stipulated in Article 10 of this Decree;

b) Must meet the provisions in Clause 3 of this Article;

c) An agreement letter from the local electric power unit.

According to the regulations above, the Department of Industry and Trade at the provincial level has the jurisdiction to issue the certificate of registration for the development of self-produced, self-consumed rooftop solar power.
