Vietnam: Supervision of drawing organization by the Lottery Supervisory Council

The supervision of drawing organization by the Lottery Supervisory Council in Vietnam is regulated in Article 10 of Circular 22/2021/TT-BTC:

1. Responsibilities of the Lottery Supervisory Council in Vietnam

a) Supervise the organization of the lottery drawing for products that the lottery enterprise is permitted to operate according to the law;

b) Supervise and inspect the quantity and origin of the devices used for the lottery drawing (lottery drums, balls, control devices, electronic scales, ball checking devices), and the technical specifications of the equipment as designed by the manufacturer to ensure standards compliance. When necessary, the Lottery Supervisory Council may request a sudden inspection of all or part of the devices used for the lottery drawing based on individual content;

c) Supervise and check the sealing of the ball containers before use in the lottery drawing;

d) Supervise and inspect the number and condition satisfaction of individuals selected to participate in the lottery drawing according to the list and related documents provided by the lottery enterprise as stipulated;

dd) Inspect the arrangement of visual devices (camera, TV screens) to ensure ease for observing and monitoring the lottery drawing process for the Lottery Supervisory Council and participants witnessing the drawing;

e) Appoint members to randomly select ball sets used for the lottery drawing;

g) Appoint members to seal and unseal devices used for the lottery drawing (lottery drums, ball containers, electronic scales, ball checking devices);

h) Supervise the shuffling of tickets before the lottery drawing for instant result lottery types;

i) Supervise compliance with regulations regarding time, location, announcement of drawing rules, and the sequence of steps in organizing the lottery drawing;

k) Supervise the activities of the person conducting the lottery drawing when performing the drawing task;

l) Sign the records confirming the supervised results and the lottery drawing results as the basis for the lottery enterprise to make prize payments and announce the results in writing to the lottery agents and participants.

2. Powers of the Lottery Supervisory Council in Vietnam

a) Randomly select balls to check for weight and size before the lottery drawing (if necessary);

b) Request the lottery enterprise to re-conduct the lottery drawing in cases where the drawing organization does not follow the order of prize categories as announced in the lottery drawing rules, or if balls fall out or get stuck in the lottery drum during the drawing;

c) Temporarily suspend the lottery drawing in the following cases:

- Devices used for the drawing are unsealed before the Lottery Supervisory Council starts its work;

- Devices do not meet the requirements for ensuring the objectivity and accuracy of drawing results;

- The drawing is conducted not according to the scheduled date, time, and location as announced by the Lottery Company;

- There are signs of fraud in the organization of the lottery drawing.

d) Request the authorities to assign members to the Lottery Supervisory Council, discipline members assigned to the Lottery Supervisory Council under their management, or propose competent authorities to investigate and handle violations or fraud indications in organizing the lottery drawing as per legal regulations;

dd) Exercise other powers as specified in this Circular and the regulations of the Lottery Supervisory Council's activities.
