The Ministry of Information and Communications announces the list of products and goods that are likely to cause unsafety in 2023 in Vietnam
Recently, the Minister of Information and Communications issued Circular 04/2023/TT-BTTTT stipulating the list of potentially unsafe products and goods under the management responsibility of the Ministry of Information and Communications.
The List of potentially unsafe products and goods is under the management responsibility of the Ministry of Information and Communications, or also known as the list of group 2 products and goods.
Pursuant to Article 3 of the Circular 04/2023/TT-BTTTT stipulating 02 lists of group 2 products and goods as follows:
- The list of specialized information and communication technology products and goods required for regulation conformity certification and announcement is in Appendix I of Circular 04/2023/TT-BTTTT.
- The list of specialized information and communication technology products and goods required to be announced in conformity with regulations in Appendix II of Circular 04/2023/TT-BTTTT.
What are principles for the management of potentially unsafe products and goods under the management responsibility of the Ministry of Information and Communications in Vietnam?
Pursuant to Article 4 of the Circular 04/2023/TT-BTTTT stipulating principles for the management of potentially unsafe products and goods under the management responsibility of the Ministry of Information and Communications in Vietnam as follows:
- The quality management of products and goods on the List of Group 2 products and goods shall comply with the regulations of the Ministry of Information and Communications on regulation conformity certification, regulation conformity announcement and quality inspection. for specialized information and communication technology products and goods and corresponding technical regulations.
- Products and goods on the List of Group 2 products and goods with integrated functions of other products and goods on the List of Group 2 products and goods subject to regulation conformity certification and full announcement of technical regulations applicable to integrated products and goods
- For products and goods on the List of group-2 products and goods subject to application of two or more national technical regulations, technical regulation conformity certification and announcement must be carried out in accordance with regulations of those technical standards.
- In case there are technical regulations promulgated before the effective date of this Circular (before July 15, 2023), regulations on regulation conformity certification and announcement are different from those in this Circular. This must comply with the provisions of this Circular.
- In case there are new technical regulations amending, supplementing or replacing technical regulations specified in the List of Group 2 products and goods, the provisions of the new technical regulations shall apply in this case.
What are bases for determining that products and goods are likely to cause unsafety in Vietnam?
Pursuant to Article 3 of the Decree 132/2008/ND-CP (amended by Clause 1, Article 1 of the Decree 74/2018/ND-CP) stipulating bases for determining that products and goods are likely to cause unsafety in Vietnam as follows:
Products and goods that are likely to cause unsafety
1. Principles for determining potentially unsafe products and goods (group 2 products and goods) are based on:
a) Potentially causing unsafety of products and goods;
b) State management requirements and capabilities in each period.
2. Possible unsafety of products and goods is determined based on one or the following factors:
a) Chemical, physical and biological nature;
b) Structure, operating principle;
c) The process of transportation, storage, preservation and use.
3. Pursuant to the provisions of Clauses 1 and 2 of this Article, line ministries shall determine group-2 products and goods and HS codes in conformity with the list of Vietnamese imports and exports attached to them. according to the explanation of reasons for selecting group-2 products and goods to develop corresponding national technical regulations and management measures for group-2 products and goods within the scope of their assigned management sectors or domains. under the provisions of Clause 2, Article 32 of this Decree.

Thus, the determination of potentially unsafe products is based on the following grounds:
- The possibility of causing unsafety of products and goods is based on the following factors:
+ Chemical, physical and biological nature.
+ Structure, working principle.
+ The process of transportation, storage, preservation and use.
- State management requirements and capabilities in each period.
Note: Circular 04/2023/TT-BTTTT takes effect from 15/7/2023.
