What are included in the list of goods for construction of a bidding package within the scope of the CPTPP Agreement in Vietnam?

Pursuant to Section 6, Appendix II issued together with Decree 09/2022/ND-CP stipulating as follows:

6. List of goods

a) For the procurement agencies listed in Clauses 3.1 and 3.2 of this Appendix, except for the Ministry of Public Security, this Decree applies to all goods, except those listed in Clause 6, Appendix I attached to this Decree;

b) The Ministry of Public Security organizes the selection of contractors according to the provisions of this Decree for bidding packages on the list mentioned in the Appendix attached to Chapter 15 of the CPTPP Agreement.

What are regulations on construction bidding packages not covered by the CPTPP Agreement in Vietnam?

Pursuant to Section 7, Appendix II issued together with Decree 09/2022/ND-CP stipulating as follows:

7. Bidding packages are not covered by the CPTPP Agreement

a) Bidding packages mentioned in Clause 8 of Appendix I to this Decree;

b) Bidding packages for provision of dredging services;

c) Bidding packages for construction services in extremely difficult areas, mountainous, deep-lying and remote areas and islands outside Vietnam's territorial sea;

d) Bidding packages for small and medium enterprises.

What are regulations on the price threshold for construction bidding packages within the scope of the EVFTA Agreement and the UKVFTA Agreement in Vietnam?

Pursuant to Section 2, Appendix III issued together with Decree 09/2022/ND-CP stipulating the price threshold for construction bidding packages within the scope of the EVFTA Agreement and the UKVFTA Agreement in Vietnam as follows:

2. Bid package price threshold

2.1. The bidding package price thresholds for bidding packages of consulting services, non-advisory services and goods procurement of local-level procurement agencies listed in Clause 3.1 of this Appendix are prescribed as follows:

a) From August 1, 2020 to the end of July 31, 2025: SDR 3,000,000;

b) From August 1, 2025 to the end of July 31, 2030: SDR 2,000,000;

c) From August 1, 2030 to the end of July 31, 2035: SDR 1,500,000;

d) From August 1, 2035 onwards: 1,000,000 SDR.

2.2. The bidding package price thresholds for construction service bidding packages of local-level procurement agencies listed in Clause 3.1 of this Appendix are prescribed as follows:

a) From August 1, 2020 to the end of July 31, 2025: SDR 40,000,000;

b) From August 1, 2025 to the end of July 31, 2030: SDR 25,000,000;

c) From August 1, 2030 to the end of July 31, 2035: SDR 20,000,000;

d) From August 1, 2035 onwards: 15,000,000 SDR.

2.3. The bidding package price thresholds for bidding packages of consulting services, non-advisory services and goods procurement of other procuring agencies listed in Clause 3.2 of this Appendix are prescribed as follows:

a) From August 1, 2020 to the end of July 31, 2025: SDR 3,000,000;

b) From August 1, 2025 to the end of July 31, 2030: SDR 2,000,000;

c) From August 1, 2030 to the end of July 31, 2035: SDR 1,500,000;

d) From August 1, 2035 onwards: 1,000,000 SDR.

2.4. The bidding package price thresholds for construction service bidding packages of other procuring agencies listed in Clause 3.2 of this Appendix are prescribed as follows:

a) From August 1, 2020 to the end of July 31, 2025: SDR 40,000,000;
