Seizure of Land-Adjacent Asset of Commercial Legal Entities: How?
Pursuant to Article 27 of Decree 44/2020/ND-CP (Effective from June 1, 2020) regulating the sequestration of assets attached to land of commercial legal entities as follows:
When sequestering an asset that is a construction work attached to land, the right to use the land must also be sequestered, except in cases where the right to use the land is not sequestered according to the provisions of the law or the separation of the sequestered asset and the land does not significantly reduce the value of that asset.
=> Thus, in principle, when the criminal enforcement agency sequesters assets attached to land of a commercial legal entity, it must also sequester the land use right.
