Regulations on Procedures for Opening a Gas Station in 2020
* First, you must meet the conditions to open a gas station as specified below:
According to Article 24 of Decree 83/2014/ND-CP stipulating the conditions for retail gasoline stations, as follows: Gasoline stations with the following conditions shall be granted a Certificate of Eligibility for Retail Gasoline by the Department of Industry and Trade:
- Owned or co-owned by merchants who are agents, general agents, authorized gasoline retailers, gasoline distributors, gasoline import-export traders, or gasoline producers with a distribution system in accordance with this Decree (the applicant merchant must be named on the Certificate of Eligibility for Retail Gasoline).
- Designed, constructed, and equipped in accordance with current regulations on gasoline retail store standards, fire safety, and environmental protection as prescribed by the competent state management agency.
- Management staff and direct business employees must be trained and certified in fire safety and environmental protection as required by current law. (according to guidelines in Circular 43/2014/TT-BTNMT).
* Prepare the application for the Certificate of Eligibility for Retail Gasoline
According to Article 25 of Decree 83/2014/ND-CP, the application includes the following documents:
- Application for a Certificate of Eligibility for Retail Gasoline according to Form No. 3 in the Appendix attached to Decree 83/2014/ND-CP;
- A copy of the Enterprise Registration Certificate of the merchant owning the gasoline retail store;
- A list of equipment of the gasoline retail store as stipulated in Clause 3 Article 24 of Decree 83/2014/ND-CP and documents proving the legality of the construction of the gasoline retail store;
- A copy of the certificate or equivalent document on the professional training of the management staff and employees of the store in accordance with Clause 4 Article 24 of Decree 83/2014/ND-CP.
You send one (01) set of documents to the Department of Industry and Trade. After receiving the application:
- In case of incomplete documents, within seven (07) working days from the date of receipt of the merchant's application, the Department of Industry and Trade shall issue a written request for supplementation.
- Within twenty (20) working days from the date of receipt of the application as prescribed, the Department of Industry and Trade is responsible for reviewing, appraising, and issuing a Certificate of Eligibility for Retail Gasoline according to Form No. 4 in the Appendix attached to this Decree to the merchant. In case of refusal to issue a certificate, the Department of Industry and Trade must respond in writing and clearly state the reason.
