Procedures and Order for Issuing Construction Permits for Advertising Works
According to the provisions of the law, the application dossier for the issuance of a construction permit for advertising works includes the following:
- Application for a construction permit for advertising works;
- Certified copy of the business registration certificate of the organization or individual applying for the construction permit for advertising works;
- A notarized copy of one of the following documents: land use right certificate; agreement or land lease contract in accordance with the land law for standalone advertising works; location lease contract between the investor of the advertising work and the owner or lawful user for advertising works attached to existing structures, or a document notifying the result of the successful bid for locations requiring a bidding process;
- In cases where the advertising work is attached to an existing structure, there must be an agreement or contract between the investor of the advertising work and the owner or the person authorized to manage the existing work;
- Design drawings by a legally authorized design organization showing the ground position, sectional and typical elevations, and the foundation plan of the work, with the signatures and seal of the investor of the advertising work. In cases where advertising works are attached to an existing structure, the design drawings must show the solution for attaching the advertising work to the existing structure.
The procedure for the issuance of construction permits for advertising works is stipulated in Clause 4, Article 31 of the Advertising Law 2012 with details as follows:
- First, the organization or individual applying for the construction permit for advertising works submits the dossier to the local competent authority in charge of construction;
Subsequently:
+ If the advertising location is within the approved advertising plan approved by the provincial People's Committee, within 15 days from the date of receipt of a valid dossier, the local competent authority in charge of construction grants the construction permit for advertising works to the organization or individual. In the case of non-issuance, a written response with specific reasons must be provided;
+ If the local plan has not been approved for advertising, within 2 working days from the date of receipt of a valid dossier, the local competent authority in charge of construction sends a document requesting opinions from related departments, agencies, or sectors. Within 5 working days from receiving the request letter, these departments must provide a written response to the local competent authority in charge of construction. Within 13 days from receiving feedback from the relevant departments, the local competent authority in charge of construction must issue the construction permit for advertising works to the organization or individual. In the case of non-issuance, a written response with specific reasons must be provided.
