Procedure for Registration of Operation of Arbitration Centers
The procedure for registering the operation of an Arbitration Center is stipulated in Article 8 of Decree 63/2011/ND-CP guiding the Law on Commercial Arbitration promulgated by the Prime Minister of the Government of Vietnam with the following content:
First, prepare one set of documents to submit to the Department of Justice. Specifically, the registration dossier includes the following documents:
- Operational registration application;
- A certified copy of the Establishment License of the Arbitration Center; in case a copy is submitted, the original must be presented for comparison;
- A certified copy of the Charter of the Arbitration Center; in case a copy is submitted, the original must be presented for comparison;
Subsequently, within 15 days from the date of receiving a valid dossier, the Department of Justice is responsible for issuing the Operational Registration Certificate to the Arbitration Center.
Within 07 working days from the date of issuing the Operational Registration Certificate to the Arbitration Center, the Department of Justice sends 01 copy of the Operational Registration Certificate to the Ministry of Justice.
Furthermore, after being granted the Operational Registration Certificate, the Arbitration Center shall carry out the announcement of its establishment and the engraving of its seal in accordance with the law.
Specifically, the establishment announcement is stipulated as follows:
- Within 30 days from the date of being issued the Operational Registration Certificate, the Arbitration Center must publish in a central daily newspaper or local newspaper where it is registered for three consecutive issues regarding the following main contents:
+ Name and address of the head office of the Arbitration Center;
+ Area of operation of the Arbitration Center;
+ Operational Registration Certificate number, issuing authority, date, month, and year of issuance;
+ The commencement date of the Arbitration Center's operation.
- The Arbitration Center must post at its headquarters the above contents and the list of Arbitrators of the Arbitration Center.
Note: The Arbitration Center is allowed to operate from the date it is issued the Operational Registration Certificate.
