Order of Implementation for Negotiation and Signing of International Treaties under the Authority of Decision of the Prime Minister the Government of Vietnam
Article 12 of Decision 3800/QD-BCT in 2018 stipulates that activities concerning the negotiation and conclusion of international treaties under the decision-making authority of the Prime Minister of the Government of Vietnam must be conducted according to the following basic procedures:
The Ministry's leadership directs and assigns the unit in charge of negotiating the international treaty.
The leading unit compiles information and submits proposals regarding the international treaty to the Ministry's leadership.
The Ministry's leadership reviews and gives opinions on the proposals from the leading unit.
The leading unit gathers evaluations from the Ministry of Justice, the Ministry of Foreign Affairs, and opinions from relevant ministries and sectors.
The leading unit compiles the opinions of the ministries and sectors and prepares the document for the Prime Minister of the Government of Vietnam requesting guidance.
After the Prime Minister of the Government of Vietnam consents, the leading unit, based on specific instructions from the Prime Minister of the Government of Vietnam, develops negotiation plans and proceeds with negotiations.
For cases involving the negotiation of a free trade agreement, the leading unit proposes the composition and establishes the negotiating team after the Prime Minister of the Government of Vietnam approves proceeding with negotiations with partners.
The leading unit cooperates with the Ministry of Foreign Affairs to review and compare the Vietnamese text with the foreign language text to ensure accuracy in content and form before proceeding with the initial signing of the international treaty.
The leading unit reports to the Ministry's leadership on the negotiation session results and the initial signing of the international treaty.
The Ministry's leadership considers and gives opinions on the initial signing.
The leading unit cooperates with the Ministry of Foreign Affairs to complete the signing procedures, international treaty documents, and organizes the official signing ceremony.
The leading unit drafts the document for the Prime Minister of the Government of Vietnam requesting approval of the international treaty if approval is needed and proceeds with the deposit of the international treaty.
The above procedures outline the negotiation and conclusion of international treaties under the decision-making authority of the Prime Minister of the Government of Vietnam.
