Will milk and functional foods for children under 06 years of age be subject to price stabilization and price declaration in Vietnam from January 1, 2025?
On November 15, 2024, the Minister of Health of Vietnam issued Circular 33/2024/TT-BYT regulating milk, functional foods, and the economic-technical characteristics concerning milk and functional foods for children under 06 years of age subject to price stabilization and price declaration.
According to Article 2 of Circular 33/2024/TT-BYT, milk and functional foods for children under 06 years of age are subject to price stabilization and price declaration as follows:
[1] Milk for children under 06 years of age subject to price stabilization and price declaration, includes the following product classifications:
- Nutritional formulas for children up to 36 months of age according to the national technical standards issued by the Ministry of Health
- Milk and nutritional products containing animal milk in powder or liquid form announced for use by children under 06 years of age but not according to the national technical standards issued by the Ministry of Health or the relevant sector management ministry.
[2] Functional foods for children under 06 years of age subject to price declaration, include the following product classifications:
- Health protection food
- Medical nutritional food (also known as nutritional food for special medical purposes)
- Supplementary foods
- Foods used for special diet policies (not containing milk)

What are economic-technical characteristics of milk and functional foods for children under 06 years of age subject to price stabilization and price declaration in Vietnam?
Based on Article 3 of Circular 33/2024/TT-BYT, the economic-technical characteristics of milk and functional foods for children under 06 years of age subject to price stabilization and price declaration include:

Milk and functional foods for children under 06 years of age subject to price stabilization and price declaration include the following economic-technical characteristics:
- Product name (detailed name);
- Product classification;
- Product form (dosage form/use form);
- Number of receipt for registration of product announcement or self-declaration number.

Which agency in Vietnam is responsible for organizing and implementing the reception of price declarations in accordance with the law on prices to ensure convenience for organizations and individuals in making declarations?
Based on Article 5 of Circular 33/2024/TT-BYT, the organization for implementation is as follows:
Article 5. Organization of Implementation
- The Provincial People's Committee is responsible for organizing the implementation of the reception of price declarations in accordance with the law on prices to ensure convenience for organizations and individuals in making declarations.
- The Department of Food Safety under the Ministry of Health issues documents requesting the agency assigned by the Provincial People's Committee to receive price declarations to send declared prices to the Ministry of Health (via the Department of Food Safety) for assessing fluctuations in the market price level and compiling price stabilization reports.
- Organizations or individuals announcing milk and functional foods for use by children under 06 years of age in the announcement dossier and on product labels (including products announced for use by various age groups, including those under 06 years of age) are responsible for sending written price declarations to the agency assigned by the Provincial People's Committee to receive price declarations in accordance with the provisions of Clause 1, Article 17, and Clause 2, Article 18 of Decree No. 85/2024/ND-CP dated July 10, 2024, of the Government of Vietnam detailing several articles of the Pricing Law.
- The Department of Food Safety under the Ministry of Health takes the lead and cooperates with relevant units to guide implementation and organization pursuant to this Circular.
According to the above regulation, the Provincial People's Committee is responsible for organizing the implementation of the reception of price declarations in accordance with the law on prices to ensure convenience for organizations and individuals in making declarations.
