What documents are included in the customs declaration dossier for export-import goods?

Based on Article 16 of Circular 38/2015/TT-BTC revised by Clause 5 Article 1 Circular 39/2018/TT-BTC which stipulate the customs dossier when conducting customs procedures:

Article 16. Customs dossier upon customs procedures

1. Customs dossier for export goods

a) Customs declaration according to the information criteria stipulated in Form No. 02 Appendix II issued with this Circular.

In case of implementing paper customs declaration as stipulated in Clause 2 Article 25 Decree No. 08/2015/ND-CP revised and supplemented by Clause 12 Article 1 Decree No. 59/2018/ND-CP dated April 20, 2018, by the Government of Vietnam, the customs declarant shall declare and submit 02 original copies of the customs declaration form HQ/2015/XK Appendix IV issued with this Circular;

b) Commercial invoice or equivalent documents in case the buyer has to pay the seller: 01 photocopy;

c) Wood product list for exported wood materials as stipulated by the Ministry of Agriculture and Rural Development: 01 original copy;

d) Export license or written permission from the competent authority according to the law on foreign trade management for export goods under license management:

d.1) If exported once: 01 original copy;

As such, the customs declaration dossier for export goods includes the following documents:

- Customs declaration

- Commercial invoice or equivalent documents in case the buyer has to pay the seller

- Wood product list for exported wood materials as stipulated by the Ministry of Agriculture and Rural Development

- Export license or written permission from the competent authority according to the law on foreign trade management for export goods under license management

+ If exported once: 01 original copy

+ If exported multiple times: 01 original copy when exporting for the first time

- Notice of exemption from inspection or notification of specialized inspection results or other documents as stipulated by the law on specialized management and inspection

- Documents proving that the organization or individual is eligible to export goods in accordance with the law on investment

- Entrustment contract

When is the deadline for submitting the customs dossier for export goods?

Based on Article 25 of the Customs Law 2014 stipulating the deadline for submitting the customs dossier:

Article 25. Deadline for submitting customs dossier

1. The deadline for submitting the customs declaration is stipulated as follows:

a) For export goods, submitted after the goods have been gathered at the location notified by the customs declarant and no later than 04 hours before the means of transport exits; for export goods sent by express delivery service, no later than 02 hours before the means of transport exits;

b) For import goods, submitted before the goods arrive at the border gate or within 30 days from the date the goods arrive at the border gate;

c) The deadline for submitting the customs declaration for means of transport is implemented according to Clause 2 Article 69 of this Law.

2. The customs declaration is valid for customs procedures within 15 days from the date of registration.

3. The deadline for submitting relevant documents in the customs dossier is stipulated as follows:

a) In case of electronic customs declaration, when the customs authority conducts inspection of the customs dossier, physical inspection of the goods, the customs declarant shall submit the paper documents in the customs dossier, except for documents already in the national single window information system;

b) In case of paper customs declaration, the customs declarant must submit or present the relevant documents when registering the customs declaration.

As such, the deadline for submitting the customs dossier for export goods is after the goods have been gathered at the location notified by the customs declarant and no later than 04 hours before the means of transport exits.

In case export goods are sent by express delivery service, the deadline is no later than 02 hours before the means of transport exits.
