Is Leasing a Business License Subject to a Fine?

According to Point b Clause 1 Article 6 of Decree 98/2020/ND-CP (effective from October 15, 2020) stipulating violations of business activities under a business license;

A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for any of the following violations:

Leasing, lending, pledging, mortgaging, selling, or transferring the business license;

Thus, in the case where your friend leases the business license, a fine ranging from VND 3,000,000 to VND 5,000,000 will be imposed according to the latest regulation.

Furthermore, additional penalties may be applied: Revocation of the business license for a period from 01 month to 03 months in case of repeated violations or recidivism. Concurrently, the violator is compelled to return any illegal profit gained from the aforementioned violation.
