What day is Black Friday in 2023 in Vietnam?

Black Friday, also known as "Thứ Sáu đen tối", is an unofficial name for the Friday immediately after Thanksgiving (an annual holiday celebrated mainly in the United States and Canada that falls on the fourth Friday in November).

Black Friday falls around November 23 - 29 every year and has been considered the opening day for the American Christmas shopping season since 1952.

In 2023, Black Friday, also known as Thanksgiving, will fall on November 24, 2023.

In what ways can customers purchase Black Friday promotional products?

According to Article 92 of the 2005 Commercial Law and Section 2, Chapter 2, Decree 81/2018/ND-CP stipulates the following forms of promotion:

[1] Giving samples of goods or providing samples of services to customers for trial use free of charge.

- Sample goods given to customers and sample services provided to customers for trial must be legally traded goods and services that the trader is selling or will sell or supply on the market.

- When receiving sample goods or sample services, customers do not have to fulfill any payment obligations.

[2] Gifting goods as gifts or providing free-of-charge services to customers.

Carry out promotions to give away goods and provide services without collecting money in the following ways:

- Giving away goods or providing services without collecting money accompanied by the purchase and sale of goods or provision of services;

- Giving away goods or providing services without collecting money without the purchase or sale of goods or provision of services.

[3] Promotion in the form of discounts

- In case of promotion in the form of price reduction, the price reduction of goods and services promoted during the promotion period at any time must comply with the regulations on the maximum reduction level.

- Do not reduce the selling price of goods or service provision in cases where the selling price of goods or services is subject to specific pricing by the State.

- Do not take advantage of this form of promotion to dump goods and services

[4] Sale of goods or provision of services together with coupons

- Vouchers for goods and services used together with goods sold or services provided are vouchers to buy goods or receive services from that trader or to buy goods and receive services of traders and other organizations.

- The maximum value of the coupon given together with a unit of goods sold or service provided during the sales promotion period must comply with regulations on the maximum material value of the promotional product.

[5] Sale of goods or provision of services together with promotional contest entry form for selecting the prize winner according to rules and prizes already announced

Promotional contests and prize-awarding day must be organized publicly and witnessed by representatives of customers and notified to Department of Trade and Industry of localities where such promotional contests and prize-awarding day are organized before the promotional contest and prize-awarding day. For the case in which total value of prizes awarded in the sales promotion is under VDN 100 million, the trader doing such sales promotion are not required to notify the Department of Trade and Industry.

[6] Sale of goods or provision of services together with participation by customers in promotional games of chance in connection with the purchase of goods or service and winning of prizes due to chance of participants according to rules and prizes already announced ( hereinafter referred to as promotional games of chance)

[7] Organization of frequent customer programs as the basis for awarding customers according to the quantity or value of goods or services purchased in the forms of customer cards or coupons acknowledging the goods or service purchase

[8] Goods or service sales promotion with the use of the Internet, electronic media or information technologies.

[9] Other forms of sales promotion if approved by the State management agency in charge of commerce.

What is maximum discount for Black Friday promotional items?

According to Article 7 of Decree 81/2018/ND-CP, regulations on maximum discount rate for the promoted product is as follows:

1. The maximum discount must not exceed 50% of the prices of such promoted product before the sales promotion.

2. For time-limited promotion prescribed in Clause 5 in Article 6, 100% discount shall be offered. 100% discount may be also applied to sales promotion activities included in programs or activities of sales promotion decided by the Prime Minister.

3. Maximum discount rate must not be applied to sales promotion of:

a) goods or services by price stabilization programs of the State;

b) fresh foods;

c) goods or service of the businesses going bankrupt, dissolving, changing their location or business sector or trade

According to this Article, the maximum discount for promoted goods and services is 50% compared to the price of those goods and services immediately before the promotional period in Vietnam.

However, there are some exceptions for businesses that do not apply this maximum discount limit in Vietnam, as follows:

[1] Business establishments carry out centralized promotions according to programs prescribed by the Government and on holidays according to the provisions of labor law

[2] Business establishments conduct promotions for the following types of goods:

- Goods and services when implementing the State's price stabilization policy;

- Fresh food products;

- Goods and services in case the enterprise goes bankrupt, dissolves, changes location, production or business lines.
