How much is the fine for naming a commercial center that does not meet the regulatory standards?
According to Point a Clause 1 Article 78 of Decree 98/2020/ND-CP which stipulates penalties for violations regarding market management, supermarket operations, and shopping centers as follows:
A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for the following violation: Naming a business establishment as a supermarket, shopping center, or equivalent term in a foreign language without ensuring standards as prescribed.
According to Clause 4 Article 4 of this Decree, the fine levels stipulated in Chapter II of this Decree are the fines applied to administrative violations committed by individuals. If an administrative violation is committed by an organization, the fine is doubled the fine level prescribed for individuals.
Article 78 belongs to Chapter II of Decree 98/2020/ND-CP.
Therefore, in case an organization names a shopping center without ensuring the prescribed standards, it may be subject to a fine ranging from VND 10,000,000 to VND 20,000,000.
