What are steps and procedures for reissuing the Certificate of eligibility to produce pesticides in Vietnam?
Pursuant to Section 1, Part II Administrative procedures amending and supplementing the field of plant protection within the scope of management functions of the Ministry of Agriculture and Rural Development issued together with Decision 373/QĐ-BNN-BVTV in 2023 regulates procedures for reissuing the Certificate of eligibility to produce pesticides, including the following steps:
Step 1: Organizations and individuals (plant protection drug production facilities) submit documents to the Plant Protection Department (3 months before the expiration date of the Certificate of eligibility to produce plant protection drugs).
Step 2: Receive and check the validity of the application within 02 working days.
If the dossier is not valid, please return it and request to supplement and complete the dossier.
Step 3: Appraise documents and establish an on-site assessment team at the facility within 05 working days.
In case the dossier does not meet the regulations, the Plant Protection Department notifies the organization or individual of the contents that need to be supplemented and completed.
Step 4: Actual assessment at the facility
+ The assessment team notifies the facility in writing 07 working days before the assessment time, the assessment time at the facility must not exceed 01 working day.
Step 5: Issue the Certificate of eligibility to produce pesticides (according to the form specified in Appendix XIX issued with Circular 21/2015/TT-BNNPTNT).
+ Within 15 working days in cases where an assessment team must be established.
+ In case the assessment results do not meet the requirements, the Plant Protection Department shall notify the facility in writing of the unsatisfactory conditions and the time limit for correction.
Within 05 working days from the date of receiving the facility's remedial report or re-inspection results, the Plant Protection Department shall issue a Certificate of eligibility to produce pesticides to the facility.
+ In case of refusal, the Plant Protection Department shall notify in writing and clearly state the reason.
