Do I need to apply for a advertising constructions license in Vietnam? What are regulations on rules for placing advertisements on advertising screens in Vietnam?
My company operates in the field of real estate, so there is a need to install a few billboards at some locations of the company and places where many customers are concentrated. Do I need to get advertising constructions license? What are rules for placing advertisements on advertising screens? Please advise. Thank you.
Do I need to apply for a advertising constructions license in Vietnam?
In Clause 2, Article 31 of the Law on Advertising 2012, licensing advertising constructions as follows:
2. The construction of outdoor advertising screens, signboards, independent billboards attached to another existing construction must be issued with the construction license from local competent agencies in charge of construction in the following cases:
a) Building outdoor advertising screens with 20 m2 of one side or above;
b) Building signboards, billboards with over 20 m2 of one side with metal structure or similar materials and attached to another existing construction.
c) Independent billboards with 40 m2 one side or above.
Thus, according to the above regulations in Vietnam, building outdoor advertising screens with 20 m2 of one side or above, must apply for a construction license from the competent local construction agency and the screen is under 20m2 or less, advertising constructions license from the competent authority is required.
What are regulations on rules for placing advertisements on advertising screens in Vietnam?
Pursuant to Article 28 of the Law on Advertising 2012, advertisements on advertising screens are as follows:
1. The positions of advertising screens must comply with this Law, other relevant law provisions and the local outdoor advertising planning.
2. Sounds must not be used in advertisements on outdoor advertising screens.
3. Sounds may be used in the advertisements on screens not being specified in Clause 2 this Article in accordance with law provisions on environment.
