Conditions on Secondary Labels of Exported Goods for Sale in Vietnam
At Article 8 of Decree 43/2017/ND-CP, there are regulations regarding the supplementary labels for exported goods when sold in Vietnam, specifically as follows:
Supplementary labels are to be used for goods that cannot be exported or are returned and brought into circulation in the market. The supplementary labels must be affixed on the goods or their commercial packaging and must not obscure the mandatory contents of the original labels.
=> For objective reasons, the goods that your company intended to export can no longer be exported. In this case, if your company intends to sell these goods in Vietnam, they must have supplementary labels affixed.
The requirements for affixing supplementary labels are as follows:
- The content on the supplementary labels must be a direct translation into Vietnamese of the mandatory content on the original labels and must include any other mandatory information that is lacking, based on the nature of the goods as stipulated in this Decree. Organizations and individuals responsible for labeling must ensure the accuracy and truthfulness of the content. The content on the supplementary labels, including any additional information, must not misrepresent the original label's content and must accurately reflect the nature and origin of the goods.
- For goods that cannot be exported or are returned and released into the market, the supplementary label must include the bolded phrase "Produced in Vietnam."
