Are Teachers Allowed to Engage in Multi-Level Marketing?
According to Clause 1 and Clause 3, Article 3 of Decree 40/2018/ND-CP on the management of multi-level marketing activities, the regulations on multi-level marketing activities are as follows:
- Multi-level marketing is a business activity that uses a network of participants comprising multiple levels and branches, in which participants receive commissions, bonuses, and other economic benefits from their own business results and those of others within the network.

- A multi-level marketing participant is an individual who enters into a contract to participate in multi-level marketing with a multi-level marketing enterprise.
As stipulated in Clause 2, Article 28 of this Decree, the following cases are prohibited from participating in multi-level marketing:
- Persons currently serving a prison sentence or having a criminal record for offenses related to the production and sale of counterfeit goods, the production and sale of prohibited goods, false advertising, deceiving customers, fraudulently appropriating assets, abusing trust to appropriate assets, illegally holding assets, offenses related to regulations on multi-level marketing;
- Foreigners without a work permit in Vietnam issued by a competent authority unless exempted by law;
- Multi-level marketing participants who have been penalized for violations of provisions in Clause 2, Clause 3, and Clause 4, Article 5 of this Decree and have not yet surpassed the period considered to have no administrative violations;
- Individuals stipulated in point c, clause 1, Article 7 of this Decree;
- Officials, civil servants as defined by law on civil servants.
Therefore, based on the above regulations, officials are currently not eligible to participate in multi-level marketing. However, as a public employee, you may participate provided you do not fall into the other disqualified categories and the school's regulations do not prohibit participation in multi-level marketing.
