According to the provisions of commercial law, a trader includes a legally established economic organization or an individual engaging in commercial activities independently, regularly, and with business registration.
In addition, Clause 1, Article 3 of Decree No. 39/2007/ND-CP concerning individuals engaged in commercial activities independently and regularly without business registration stipulates the following:Individuals engaged in street trading are those who independently carry out one, several, or all activities permitted by law on a daily basis, such as buying and selling goods, providing services, and other profit-making activities that are not subject to business registration according to the law on business registration, and are not referred to as "traders" under the provisions of the Commercial Law.
=> Therefore, according to this provision, a street vendor is not considered a trader.
