Pursuant to Clause 2, Article 7 of the aforementioned document which specifies as follows:
- For administrative decisions and administrative acts of ministers, heads of agencies of ministerial rank, heads of agencies under the Government of Vietnam (hereinafter collectively referred to as ministers), the complainant shall file a complaint to the minister or file an administrative lawsuit in Court in accordance with the Law on Administrative Procedures.
If the complainant does not agree with the complaint resolution decision of the minister or if the complaint is not resolved within the prescribed time limit, the complainant has the right to file an administrative lawsuit in Court in accordance with the Law on Administrative Procedures.
