Article 2. Interpretation of Terms
In this Law, the following terms are understood as follows:
1. Pharmacy means drugs and materials for making drugs.
2. Drug means a preparation containing pharmaceutical substances or medicinal herbal materials used for humans for the purpose of disease prevention, diagnosis, treatment, alleviation, or adjustment of physiological functions, including pharmaceutical drugs, herbal drugs, traditional medicines, vaccines, and biological products.
3. Materials for making drugs are components involved in the structure of drugs, including pharmaceutical substances, medicinal herbal materials, excipients, and capsule shells used in the drug production process.
4. Pharmaceutical substance (also called active substance) is a substance or mixture of substances used to produce drugs, having pharmacological effects or direct effects in disease prevention, diagnosis, treatment, alleviation, or adjustment of physiological functions of the human body.
5. Medicinal Herbal Material is a natural material from plants, animals, minerals that meets the standards for making drugs.

Article 3. List of poisonous medicinal herbal materials in Vietnam
Issued together with this Circular, the List of poisonous medicinal herbal materials in Vietnam includes:
- The list of toxic medicinal herbs of plant origin as stipulated in Appendix I issued together with this Circular.
- The list of toxic medicinal herbs of animal origin as stipulated in Appendix II issued together with this Circular.
- The list of toxic medicinal herbs of mineral origin as stipulated in Appendix III issued together with this Circular.

Criteria for selecting sources of the List of poisonous medicinal herbal materials in Vietnam in Vietnam
According to Article 2 Circular 13/2024/TT-BYT, which stipulates principles for building and criteria for selecting medicinal herbs into the List of poisonous medicinal herbal materials in Vietnam
Article 2. Principles for Building and Criteria for Selecting Medicinal Herbs into the List of poisonous medicinal herbal materials in Vietnam
- Principles for building the List of poisonous medicinal herbal materials in Vietnam
a) Harmonized with the guidelines of countries in the region and the world on the classification of toxic medicinal herbs for making drugs;
b) Consistent with databases on toxic medicinal herbs for making drugs around the world;
c) Inherit the previously issued List of poisonous medicinal herbal materials in Vietnam.
2. Criteria for selecting medicinal herbs into the List of poisonous medicinal herbal materials in Vietnam
Medicinal herbs are considered for inclusion in the List of poisonous medicinal herbal materials in Vietnam when they meet one of the following criteria:
a) The herb has a monograph in the Vietnam Pharmacopoeia or pharmacopoeias of countries worldwide containing information on the herb's toxicity, high toxicity (excluding cases of low toxicity);
b) The herb has high toxicity that adversely affects the health, life of the user;
c) The herb has serious adverse reactions known during use or has been warned by the World Health Organization, a competent authority in Vietnam, or a competent authority abroad.
Thus, medicinal herbs are considered for inclusion in the List of poisonous medicinal herbal materials in Vietnam when they meet one of the following criteria:
- The herb has a monograph in the Vietnam Pharmacopoeia or pharmacopoeias of countries worldwide containing information on the herb's toxicity, high toxicity (excluding cases of low toxicity).
- The herb has high toxicity that adversely affects the health, life of the user.
- The herb has serious adverse reactions known during use or has been warned by the World Health Organization, a competent authority in Vietnam, or a competent authority abroad.
