Non-compliance with Body Temperature Check Order: What is the Fine?
Clause 7, Article 8 of the Law on Prevention and Control of Infectious Diseases 2007 stipulates one of the prohibited acts:
Failure to comply with measures for preventing and controlling infectious diseases as required by competent agencies and organizations.
On April 1, 2020, the Prime Minister of the Government of Vietnam declared Covid-19 (an acute respiratory disease caused by a new strain of Coronavirus) as a group A infectious disease, with the risk at the level of a global pandemic.
And according to Clause 2, Article 53 of the Law on Prevention and Control of Infectious Diseases 2007:
The head of the epidemic prevention committee establishes checkpoints and quarantine stations at the entrances and exits of epidemic areas to implement measures.
Thus, the act of not complying with temperature measurement orders when required by the competent authority is a violation of the law. According to Clause 5a, Article 11 of Decree 176/2013/ND-CP, failure to comply with decisions on inspection, supervision, or medical treatment before entering or leaving group A epidemic areas may result in a fine of 10 to 20 million VND.
