Can Doctors from Private Hospitals Open Clinics?
Article 12 of Decree 109/2016/ND-CP on Professional Practice Principles states:
...
- Practitioners at state-owned medical examination and treatment facilities are not allowed to register as the head of private hospitals or medical examination and treatment facilities established and operating under the Law on Enterprises or the Law on Cooperatives, except in cases where they are appointed by competent state agencies to participate in the management and administration of medical examination and treatment facilities with state capital contributions....
This regulation only prohibits doctors at state-owned medical examination and treatment facilities from registering as the head of private hospitals or after-hours medical examination and treatment facilities.
Currently, there are no regulations prohibiting doctors at private hospitals from opening after-hours clinics.
=> Therefore, doctors at private hospitals are still allowed to open after-hours clinics.
