When shall a healthcare facility in Vietnam refuse to provide medical examination and treatment?
Based on Article 59 of the Law on Medical Examination and Treatment 2023 outlining the rights of medical examination and treatment facilities:
Article 59. Rights of medical examination and treatment facilities
- Perform medical examination and treatment activities as stipulated by this Law.
- Have the right to refuse medical examination and treatment in the following cases:
a) Beyond their professional capacity or outside the professional scope of the facility, except for cases of emergency as provided in Article 61 of this Law.
b) Fall under any of the cases specified in clauses 3, 4, and 5 of Article 40 of this Law.

Medical facilities can refuse treatment under the following circumstances:
- Beyond their professional capacity or not within the professional scope of the facility, except in emergencies.
- Patients or their family members exhibit behaviors threatening the body, health, or life of the practitioners during duty, except if the person has a mental illness or other illness that impairs recognition or control.
- Patients demand examination and treatment methods that do not comply with technical professional regulations.
- Patients or their representatives do not adhere to diagnosis or treatment methods prescribed by practitioners after being advised or motivated, where such noncompliance poses a risk to the patient's health or life.
What are the organizational forms of medical examination and treatment facilities in Vietnam?
Pursuant to Article 48 of the Law on Medical Examination and Treatment 2023, the organizational forms of medical examination and treatment facilities include:
- Hospitals
- Infirmaries under the people's armed forces
- Maternity homes
- Clinics
- Traditional medicine treatment rooms
- Paraclinical service providers
- Health stations
- Outpatient emergency facilities
- Family medical practice clinics
- Other forms of medical examination and treatment facilities as prescribed by the Government of Vietnam
