    • The Ministry of Industry and Trade of Vietnam requires to ensure electricity supply by the end of 2023 and in the following years

      On September 29, 2023, the Ministry of Industry and Trade issued Official Telegram 6718/CĐ-BCT in 2023 on ensuring electricity supply by the end of 2023 and in the following years.

      In order to implement the urgent and important tasks according to the approved Power Development Plan 8 at Decision 500/QĐ-TTg in 2023, and to avoid repeating the incidents of power shortages that have occurred in the recent period, the Minister of Industry and Trade has requirements for the following:

      - Vietnam Electricity Group (EVN) to implement the following tasks:

      + Proactively develop plans and operating methods for the national power system with the goal of ensuring electricity supply under flexible scenarios to respond to power supply difficulties.

      + Urgently review the supply and demand of electricity, the capacity of the national power system, especially for the northern region by 2025 and 2030, and report to the Ministry of Industry and Trade before November 30, 2023.

      + Direct its subsidiaries to perform well in the maintenance and repair of power plants, transmission and distribution grids to ensure operation at the designed capacity; prepare ready-made plans and resources to promptly repair and quickly resolve breakdowns and incidents, do well in forecasting, warning, and disaster prevention, etc. for power plants, transmission and distribution grids to operate safely and efficiently.

      + Focus on accelerating the progress of investment, construction and commissioning of power plants and transmission and distribution projects that are assigned as the investor, especially key power and transmission projects serving power supply for the North such as the 500kV third circuit, the expanded Hòa Bình Hydropower Plant, and the Quảng Trạch I Thermal Power Plant.

      + Study and propose solutions to invest more power in the northern region to ensure sufficient power supply by 2030.

      In addition, the Minister of Industry and Trade also has a number of key requirements as follows:

      - For the Vietnam Coal and Mineral Industries Group, Vietnam Oil and Gas Group, and the Đông Bắc Corporation:

      + Ensure adequate supply of coal and gas for power plants according to production needs and signed fuel supply contracts; closely coordinate with EVN in implementing solutions to ensure power supply in the coming time.

      - For power plant investors:

      + Urgently implement the correct procedures for each step in accordance with the law for the investment projects to bring the project into operation as soon as possible.

      + Closely coordinate with relevant government agencies to fully and correctly implement land compensation, resettlement, and environmental requirements for the project.

      + For the Provincial People's Committees of the centrally-run cities and provinces:

      - Direct the relevant units to

      + Urge the investors of power projects in the locality to urgently implement the project, meet the progress according to the approved Power Development Plan VIII, and promptly resolve difficulties and obstacles related to land compensation and resettlement under the authority.

      + Urgently select investors for power projects under the authority in accordance with the law.

      What are policies and measures to encourage and promote electricity savings in Vietnam?

      Pursuant to Article 13 of the Law on Electricity in 2004 (amended by Clause 1 Article 2 of the Law on amending and supplementing a number of articles of the Law on Electricity in 2012) stipulating policies and measures to encourage and promote electricity savings in Vietnam as follows:

      Policies and measures to encourage and promote electricity savings

      1. The State shall support and encourage electricity savings with the following policies:

      a) Encouraging the domestic manufacture or the import of, applying tax preferences to, products on the lists of electricity-saving products and equipment, supplies, technological chains imported for manufacture of electricity-saving products;

      b) Providing preferential loans from the Development Assistance Fund and the Scientific and Technological Development Fund to projects applying scientific research and technological development results, investment projects on manufacture of electricity-saving products or investment projects on electricity savings;

      c) Providing investment, electricity price and tax preferences as guided by the Ministry of Industry and Trade to investment projects on development of power plants using sources or new energy or renewable energy.

      2. The ministries, ministerial-level agencies, Government-attached agencies, provincial-level People's Committees shall have to draw up programs and projects on promotion of thrifty and efficient use of electricity; arrange satisfactory funding for scientific research and technological development in service of the electricity-saving objectives.

      3. Basing itself on the socio-economic development objectives, the Industry Ministry shall coordinate with the relevant ministries and/or branches in drawing up the national target programs on energy savings and submit them to the Prime Minister for decision.

      As regulations above, the State shall support and encourage electricity savings with the following policies:

      - Encouraging the domestic manufacture or the import of, applying tax preferences to, products on the lists of electricity-saving products and equipment, supplies, technological chains imported for manufacture of electricity-saving products;

      - Providing preferential loans from the Development Assistance Fund and the Scientific and Technological Development Fund to projects applying scientific research and technological development results, investment projects on manufacture of electricity-saving products or investment projects on electricity savings;

      - Providing investment, electricity price and tax preferences as guided by the Ministry of Industry and Trade to investment projects on development of power plants using sources or new energy or renewable energy.

      What are prohibited acts in electricity activities and electricity use in Vietnam?

      Pursuant to Article 13 of the Law on Electricity in 2004 stipulating prohibited acts in electricity activities and electricity use in Vietnam as follows:

      - Destroying electrical equipment and facilities, electricity-measuring or counting equipment or electricity works.

      - Conducting electricity activities without permits as provided for by this Law.

      - Switching on, switching off electricity supply illegally.

      - Violating the regulations on safety in electricity generation, transmission, distribution and use.

      - Obstructing the inspection of electricity activities and use.

      - Stealing electricity.

      - Using electricity as animal traps or protection means, except for cases prescribed in Article 59 of this Law.

      - Violating the regulations on protection of electricity grid safety corridors, on safe distances of transmission tines and transformer stations.

      - Supplying untruthful information, thus causing harms to the legitimate rights and interests of organizations or individuals conducting electricity activities or using electricity.

      - Abusing positions and/or powers to harass for bribes, cause troubles, earn illicit profits in electricity activities and/or electricity use.

      - Other acts of violation prescribed by electricity legislation.
