Lending or Leasing Groundwater Drilling Licenses: What is the Penalty?

Based on Clauses 3, 5, and 6, Article 11 of the Decree 36/2020/ND-CP stipulating penalties for individuals violating regulations on groundwater drilling practice as follows:

Lending or leasing the license:

- Fines ranging from 10,000,000 VND to 20,000,000 VND for works with casing or wall pipe diameter less than 110 mm and a flow rate of less than 200 m3/day-night.

- Fines ranging from 30,000,000 VND to 40,000,000 VND for works with casing or wall pipe diameter less than 250 mm and a flow rate from 200 m3/day-night to less than 3,000 m3/day-night.

- Fines ranging from 40,000,000 VND to 50,000,000 VND for other scales not covered by the two cases above.

Additional penalties: Revocation of the groundwater drilling license for a period ranging from 03 months to 06 months.

According to Clause 1, Article 5 of the above regulation, the monetary penalty for each administrative violation specified in Chapters II and III of this Decree is the penalty for individuals. The fine for business households is applied as the fine for individuals. The fine for organizations is double the fine for individuals.

=> Thus, depending on the scale of the work, organizations lending or leasing the groundwater drilling license will be fined from 20,000,000 VND to 100,000,000 VND.
