What does the application for issuance of Certificate of eligibility for providing valuation services in Vietnam include?
Based on Article 5 Decree 78/2024/ND-CP stipulating the dossier for requesting the issuance, re-issuance of the Certificate of eligibility for providing valuation services:
Article 5. Application for requesting the issuance, re-issuance of the Certificate of eligibility for providing valuation services
- Dossier for requesting the issuance of the Certificate of eligibility for providing valuation services includes:
a) Request form for issuance, re-issuance of the Certificate of eligibility for providing valuation services according to Form No. 05 stipulated in the Appendix attached to this Decree;
b) Copies of the enterprise registration certificate; copies of branch registration certificates in case the applicant enterprise has an appraisal branch;

The application for issuance of Certificate of eligibility for providing valuation services in Vietnam includes the following documents:
[1] Request form for issuance, re-issuance of the Certificate of eligibility for providing valuation services
[2] Copies of the enterprise registration certificate; copies of branch registration certificates in case the applicant enterprise has an appraisal enterprise branch
[3] Registration dossier for the appraisal profession by at least 05 people with appraisal registration cards in the enterprise
In case the applicant enterprise has an appraisal enterprise branch, each appraisal enterprise branch needs additional registration dossiers for at least 03 people with appraisal registration cards
[4] List with confirmation from the enterprise about contributing members, shareholders who have an appraisal registration card in the enterprise, contributing members, shareholders who are organizations or valid electronic copies of this list in case there’s no information about the list of contributing members and shareholders in the enterprise registration certificate
[5] Certified copies or valid electronic copies of documents appointing individuals authorized as representatives of contributing members, shareholders who are organizations as per the law on enterprises.
What are the obligations of an appraisal enterprise?
Based on paragraph 2 Article 53 Law on Prices 2023 stipulating that an appraisal enterprise has the following obligations:
- Comply with regulations on appraisal activities as prescribed
- Conduct appraisals in accordance with the appraisal contract and the permitted areas of expertise
- Arrange appraisers with the required professional and operational capacities to perform the appraisal as per the signed contract
- Facilitate appraisers in executing independent and objective appraisal activities
- Develop and implement systems to control the quality of appraisal reports for issuing and providing appraisal certificates to clients
- Ensure issued appraisal certificates comply with the Vietnamese Valuation Standards unless clients intentionally provide false property appraisal information
- Be liable to clients for the provision of appraisal services according to signed contracts
- Compensate damages according to the law for violations of agreements in the appraisal contract or in cases where appraisal activities harm the interests of agencies, organizations, or individuals due to non-compliance with appraisal regulations
- Purchase professional liability insurance for appraisal activities or establish a professional risk reserve fund as prescribed by the Minister of Finance
- Manage and oversee the activities of appraisers at the enterprise
- Fully implement policies on appraisal activity reporting as prescribed by the Minister of Finance
- Organize the safe, complete, legal, and confidential preservation and storage of appraisal files and documents following the law on archiving
- Other obligations as prescribed by law
