DOCUMENT OF NON-PROJECT ASSISTANCE FUNDED BY THE ODA GRANT
(Attached to Decree No. 114/2021/ND-CP dated December 16, 2021 of the Government)

I. BASIC INFORMATION ABOUT THE PROJECT

1. Project name (Vietnamese and English).

2. Managing agency, proposing unit and project owner (expected): Name, address and other relevant information.

3. Foreign sponsors and co-sponsors (if any) are expected to support program implementation.

4. Estimated time.

5. Implementation location.

II. NEED FOR NON-PROJECT FUNDS

1. State the necessity and need for non-project funding.

2. Basis for proposing foreign sponsors.

III. GOAL AND CONTENT OF THE NON-PROJECT

Clearly state the general goals, specific goals and content of the non-project.

IV. NON-PROJECT IMPLEMENTATION MANAGEMENT ORGANIZATION

Clearly state the coordination mechanism between parties involved in implementation preparation, implementation and non-project management; capacity to organize and manage non-project implementation of the project owner.

V. TOTAL CAPITAL OF THE NON-PROJECT

1. ODA capital, concessional loans (original currency and converted to Vietnamese Dong and US dollars).

2. Source and counterpart capital (Vietnamese Dong and converted to US dollars).

3. Financial mechanism.

VI. BINDING CONDITIONS ON THE USE OF NON-REFUNDABLE ODA CAPITAL OF FOREIGN SPONSORS

Explanation of binding conditions on the use of non-refundable ODA capital from foreign donors (if any).

SAMPLE DECISION TO ESTABLISH A MANAGEMENT UNIT OF PROJECT FUNDED BY ODA AND CONCESSIONAL LOANS

DECISION

Establishment of Project Management Unit (Program and project name)

(NAME OF MANAGING AGENCY OR PROJECT OWNER)

Pursuant to Decree No. .../2021/ND-CP dated ... month ... 2021 on management and use of official development assistance (ODA) capital and concessional loans from foreign donors outside;

Pursuant to (name of document) number ... date ... month ... year ... decision on the functions, tasks and powers of (Governing agency);

Pursuant to Decision No.... date... month... year... of (Agency competent to approve program and project documents) or Decision No. date... month... year ... of (Authority competent to approve investment policies for programs and projects) (in case of prior implementation of the establishment of a Project Management Unit) (Name of program or project) judgment);

Pursuant to Decision No.... date... month... year... of (Competent Authority) on the functions, tasks, and powers of (Project Owner);

At the request of (Head of the agency or unit assigned to implement the program or project as the Project Management Unit) on the establishment of the Project Management Unit (Project Management Unit).

DECISION:

Article 1. Establishment of the Project Management Unit (Name of program, project and non-project aid in Vietnamese and English) sponsored by (donor name). Programs, projects and non-project aid with total capital (ODA capital, concessional loans and counterpart capital), implemented during the period from date ... month ... year ... to date ... Year...

Article 2. The Project Management Unit is responsible for managing the implementation of programs, projects and aid in accordance with the objectives, progress, quality and resources stated in program and project documents approved by competent authorities and International treaties/specific international agreements on ODA and concessional loans for programs, projects, and non-project aid.

Article 3. The Project Management Unit is allowed to open accounts at the State Treasury and Commercial Banks, and is allowed to use its own seal (or use the seal of the managing agency or Project Owner) to serve the preparation, prepare for project implementation (within the framework of previous implementation activities) and implement programs and projects.

Article 4. Appoint Mr/Mrs ……… as Director of Project Management Unit.

Article 5. Appoint Mr/Mrs ……… as Deputy Director of the Project Management Unit (if any).

Article 6. Appoint Mr./Ms. ……….as Chief Accountant or Officer in charge of accounting of the program or project.

Article 7. The Director of the Project Management Unit is responsible for developing the Regulations on organization and operation of the Project Management Unit (Name of the program or project) and submit it to the (Managing agency or Project Owner) for approval within 15 working days since this Decision takes effect.

Article 8. Operational term of the Project Management Unit

The Project Management Unit is dissolved according to the Decision of the (Executive Agency or Project Owner) from the date of completion report and finalization report of the program and project approved by the competent authority and the disposal of assets of the Project Management Unit has been completed.

Article 9. This Decision takes effect from the date of signing. The Director of the Project Management Unit and Heads of relevant units are responsible for implementing this Decision.
