What are regulations on building economic and technical service norms using state budget to respond to and handle radiation incidents in Vietnam?
Pursuant to Clause 1, Article 3, Circular 08/2022/TT-BKHCN (effective from July 22, 2022) develops applicable norms specified in the following legal documents:
a) Decision No. 884/QD-TTg dated June 16, 2017 of the Prime Minister promulgating the National Nuclear and Radiation Incident Response Plan;
b) Circular No. 19/2012/TT-BKHCN dated November 8, 2012 of the Minister of Science and Technology regulating the control and assurance of safety in occupational and public irradiation;
c) Circular No. 13/2014/TTLT-BKHCN-BYT dated June 9, 2014 of the Minister of Science and Technology and the Minister of Health regulating radiation safety in healthcare has been amended, supplemented by Circular No. 13/2018/TT-BKHCN dated September 5, 2018 of the Minister of Science and Technology;
d) Circular No. 25/2014/TT-BKHCN dated October 8, 2014 of the Minister of Science and Technology regulating preparation and response to radiation and nuclear incidents, preparation and approval of plans radiation and nuclear incident response planning;
d) Circular No. 28/2015/TT-BKHCN dated December 30, 2015 of the Minister of Science and Technology promulgating National Technical Regulations on general X-ray equipment for medical use (Name: QCVN 11:2015/BKHCN);
e) Circular No. 02/2016/TT-BKHCN dated March 25, 2016 of the Minister of Science and Technology promulgating National Technical Regulations on computed tomography equipment for medical use (Name: QCVN 12:2016/BKHCN);
g) Circular No. 15/2017/TT-BKHCN dated December 5, 2017 of the Minister of Science and Technology promulgating National Technical Regulations for linear accelerators used in radiotherapy (Name: QCVN 13:2017/BKHCN);
h) Circular No. 14/2018/TT-BKHCN dated November 15, 2018 of the Minister of Science and Technology promulgating 03 National Technical Regulations on X-ray equipment for medical use (Regulations National technical regulations for mobile X-ray equipment for medical use, name: QCVN 15:2018/BKHCN; National technical regulations for television brightening X-ray equipment for medical use, name: QCVN 16:2018/BKHCN; National technical regulations for dental X-ray equipment for medical use, name: QCVN 16:2018/BKHCN);
i) Circular No. 45/2018/TT-BTC dated May 7, 2018 of the Ministry of Finance guiding the management regime, calculation of depreciation and amortization of fixed assets at agencies, organizations, units and fixed assets assigned by the State to enterprises for management do not include state capital in the enterprise;
k) Circular No. 22/2019/TT-BKHCN dated December 20, 2019 of the Minister of Science and Technology promulgating national technical regulations for mammography X-ray equipment and loaded brachytherapy equipment rear source by remote control (Name: QCVN 21:2019/BKHCN and QCVN 22:2019/BKHCN).

According to Clause 2, Article 3, Circular 08/2022/TT-BKHCN (effective from July 22, 2022), norms that do not have legal documents specifically stipulate construction according to the following methods:
Norms do not have legal documents specifically regulating construction according to the methods specified in Article 10 of Circular No. 21/2019/TT-BKHCN dated December 18, 2019 of the Minister of Science and Technology regulations. Process for building economic - technical norms for public service services using state budget in the field of state management of the Ministry of Science and Technology (hereinafter referred to as Circular No. 21/2019/TT -BKHCN), including 03 methods:
a) General statistical method
On the basis of annual statistical data or reporting periods (3 consecutive years before the time of establishing economic-technical norms) and practical experience in responding to and handling radiation incidents and nuclear accident; personal radiation dose measurement; inspecting and calibrating radiation measuring equipment belonging to state agencies and public service units in ministries, branches and localities.
b) Method of applying standards
On the basis of technical standards and legal regulations on working time and rest regime to build labor norms for each job; Based on technical standards and legal regulations to determine the consumption level of materials and equipment for each job, on that basis calculate and build economic-technical norms.
c) Analytical and experimental methods
Based on the implementation of rehearsal activities and experimental surveys according to the outline of each corresponding service implementation process, the work content to analyze and calculate the elements constituting the norms applied to the work in responding to and handling radiation and nuclear incidents; personal radiation dose measurement; Verifying and calibrating radiation measuring equipment.
