Clause 5, Article 1 of Decree 31/2020/ND-CP stipulates the circumstances under which administrative violation vehicles shall not be handed over to violating organizations or individuals for custody and preservation:
- The vehicle involved in the violation is evidence in a criminal case;
- The vehicle is used for illegal racing, resisting law enforcement officers, disturbing public order, or causing traffic accidents;
- The vehicle registration certificate is forged or altered;
- Fake license plates, vehicles illegally altered to change chassis or engine numbers, or vehicles with erased chassis or engine numbers.
=> Therefore, according to the above regulation, vehicles involved in a violation that are evidence in a criminal case shall not be handed over to individuals or organizations for custody and preservation.
