Public Products and Services: Definitions and Regulations
Products and public utility services are defined in Clause 4, Article 3 of Decree 32/2019/ND-CP. Specifically:
Public utility products and services are those whose production and supply following market mechanisms are unlikely to recover costs, or which have particular characteristics; subsidized by the State for the difference between the selling price, and the product and service price as prescribed by the State, or the difference between the amount paid by beneficiaries of public utility products and services under State regulations, and the reasonable costs incurred by producers and suppliers of public utility products and services to produce and supply these products and services as ordered by the State (or as assigned tasks under specialized laws, if any).
