Management and Utilization of Funds for Maintenance and Repair of Public Assets - Regulations
Management and use of funds for maintenance and repair of public assets are stipulated in Article 5 of Circular 65/2021/TT-BTC. Specifically:
The management and use of funds for maintenance and repair of public assets are implemented under the provisions of the Law on State Budget, Decree No. 163/2016/ND-CP dated December 21, 2016, of the Government of Vietnam detailing and guiding the implementation of the Law on State Budget; Decree No. 11/2020/ND-CP dated January 20, 2020, of the Government of Vietnam on administrative procedures within the State Treasury domain; Circular No. 342/2016/TT-BTC dated December 30, 2016, detailing and guiding some articles of Decree No. 163/2016/ND-CP dated December 21, 2016, of the Government of Vietnam detailing and guiding the implementation of the Law on State Budget; Circular No. 62/2020/TT-BTC dated June 22, 2020, of the Ministry of Finance guiding the control and payment of recurrent expenditures from the state budget via the State Treasury; Circulars of the Ministry of Finance on the annual organization and implementation of the state budget estimates.
This Circular additionally guides certain provisions on funds for maintenance and repair of construction works and equipment as follows:
a) When allocating budget estimates for maintenance and repair of construction works and equipment, accompanying documentation includes: Approval decision of the competent authority and related documents (if any); specific explanations of the following contents: Technical-economic standards for maintenance and repair; names of public assets needing maintenance and repair; the most recent maintenance and repair time of public assets; reasons, objectives, and volume of maintenance and repair of public assets; allocated funds; estimated implementation duration and completion time;
b) When controlling expenditures, advances, and payments for repairing construction works and equipment: Implement according to Clause 4, Article 35 of Decree No. 06/2021/ND-CP dated January 26, 2021, of the Government of Vietnam detailing certain contents on quality management and maintenance of construction works; specifically:
- For repair cases of construction works and equipment with a repair cost estimate under 500 million VND: The head of the agency or unit managing the public assets approves the repair plan, fully explaining the contents mentioned in point a, clause 2 of this Article;
- For repair cases of construction works and equipment with a repair cost estimate of 500 million VND or more: The head of the agency or unit managing the public assets organizes the preparation, appraisal, and approval of the economic-technical report or construction investment project as per the laws on construction investment.
- Funds for planning repairs, preparing economic-technical reports, and preparing maintenance and repair estimates for public assets are used within the annual state budget estimates allocated to the agency or unit.
