Is a 75-year-old eligible for a monthly allowance?
According to Article 2 of the 2009 Law on the Elderly, elderly persons as defined in this Law are Vietnamese citizens who are 60 years of age or older.
Pursuant to Clause 5, Article 5 of Decree 136/2013/ND-CP, elderly persons falling into one of the following categories are entitled to a monthly social assistance allowance:
- Elderly persons from poor households without any individuals obligated and entitled to provide support, or with individuals obligated and entitled to provide support but these individuals are currently receiving monthly social assistance policies;
- Elderly persons from poor households without any individuals obligated and entitled to provide support, without the means to live in the community, eligible for admission to social support facilities, social houses but have someone willing to care for them in the community.
Thus, if your grandmother is 75 years old this year and holds a poor household certificate and meets the other cited conditions above, she is eligible for a monthly social assistance allowance.
In the event that these conditions are not fully met, your grandmother is not entitled to a monthly social assistance allowance.
