Forms of Disclosure on the Organization and Operations of Agencies and Organizational Units
On November 20, 2018, the National Assembly of the Socialist Republic of Vietnam, Session XIV, at its 6th meeting, passed the Law on Anti-Corruption No. 36/2018/QH14 (referred to as the Law on Anti-Corruption 2018).
The Law on Anti-Corruption 2018 regulates the prevention and detection of corruption; handling corruption and other acts violating the law on anti-corruption.
According to the provisions of Article 11 of the Law on Anti-Corruption 2018 (effective from July 1, 2019), the forms of disclosure regarding the organization and activities of agencies, organizations, and units are specifically stipulated as follows:
The forms of disclosure include:
- Announcement at meetings of the agency, organization, or unit;
- Posting at the headquarters of the agency, organization, or unit;
- Notification in writing to relevant agencies, organizations, units, and individuals;
- Issuance of publications;
- Announcement on mass media;
- Publication on electronic portals, websites;
- Organizing press conferences;
- Providing information upon the request of agencies, organizations, units, or individuals.
Note: In cases where other laws do not provide for the forms of disclosure, the head of the agency, organization, or unit must implement one or several forms of disclosure as specified in Points b, c, d, e, f, and g of Clause 1, Article 11 of the Law on Anti-Corruption 2018. The head of the agency, organization, or unit may choose to additionally implement the forms of disclosure as specified in Points a and h of Clause 1, Article 11 of the Law on Anti-Corruption 2018.
